ok so i get an email today at 1:15 but dindt see it till 2:30...anyway tom, the body shop manager at jmk leaves me one line

KEN CHECK YOUR VOICEMAIL

sooo i do just that....

what do i hear,

hey ken its tom from jmk, i talked to the bmw rep, did a little work and what i could, they are going to represent this case and pay for 100% of damages, im not going to be around today but get in contact with me about how things are going to be done and we will start it up.

HOW HUGE IS THIS!!!!!!!!!

guys this is great news for every1....
with enough proper complaining you can get somewhere with these things

but anyway the rebuild starts monday morning....i am so happy right now im going to go buy tom at jmk a nice ass expensive bottle of something really expensive as my first purchase as being 21 on sunday...

so car is 100% covered im happy as a pig in mud and im going to be able to sleep tonight....yay to havin my car fixed

so every1 can now attempt to use my case as an example...i with a 1.9 had damage and got it for 100%....i will take extensive pictures before and after the fix...everything that happened is documented if anybody wants it....

...i havent had this kind of mood swing in a 24 hour period in my entire life....

It's really amazing that you got it resolved this quickly. Maybe it's because you had a good relationship with your dealer? I gotta start buying more keychains from BMW of Fairfax...

When I lived in NJ, I had my service done at JMK. The parts guy, Ben is awesome.

I wish I still lived in NJ but not during the winter months.

Be sure to take pics before they fix it if you can.

Interesting precedent though. At this point, they will have a much harder time denying these claims. They would not fix a 6 year old car if they did not believe that there was an issue there.

Does bring up some stuff though:

1. Do they just fix it back to stock/OEM? Does it happen again?
2. Does the car have to start to show the problem, or does it need to be catastrophic?

Still, a very good precedent.

ok...bmw field servic representatives name was Jason Klosk

Tom Gillespie is the body shop manager at jmk and its rediculous how much he helped and gave advise and worked his strings i guess talking to bmw and i cant thank him enough right now...

the car will have an entire new floor pan assembly put on...its estimated close to 50 hours of work, so this is a HUGE job....this will be brand new parts therefore completely bringing the car back to oem standing, which means i dont think i have a problem to worry about anytime soon...and i will once i get it back, IF i keep the car, evantually take the necessary steps to have it reinforced somewhere

i think there was also some large name attorney that made contact with bmwna on behalf of my fathers connections with a lot of people in the city, but none the less my case is settled in my eyes and my baby will be fixed again...

hopefully i can talk him into lettin me keep it now!!!

honestly you guys have NO idea how happy i am...i just like jumped out of my desk at work and startin runnin around hahaha

every1 here knew about it bc i was explaining everything that was goin on...they were like THATS AWESOME!!! sooo yea im like speechless without words that this will be taken care of....

lol seriously..the market value is barely 10,000 right now...hell spendin over 50% of the cars value to fix it is crazy...well watever its their decision

yea you just about hit the nail on the head....NOW we can only hope this leads to bigger and better things for everyone possibly involved with this case...so when i DO buy my coupe next year, i wont have to argue again, and they will just fix it muuuhahahaha

i am not submitting anything to the alabama case...i have gotten my reimbursement and will settle and stay happy for the amazing amount that was done for me already, i dont wanna push any buttons and press my luck...

however you all have my full aproval to use any information and pictures that will be documented what so ever in anyway you would like for your incidents and any cases or law claims that may follow

and yes i must repeat as much as possible that i cant give enough respect to jmk bmw in springfield and how they dealt with this situation...i have to say they were not the 1st bmw certified bodyshop in the country for nothing!!! the guys there are simply amazing, customer service is top notch, it does NOT get any better then what these guys have to offer...i will not even talk to another bmw dealer for the rest of my life based on how well they are treating me....

i will praise them even more when the job is complete because i know they do not do anything other then pure perfection!!!

Congrats! That is wonderful news.

JMK has a great reputation for taking care of things like this. They have an excellent relationship with BMWNA which is why they are able to provide such service. My 3.0 received a new clutch and a new sub woofer free of charge to me, when other dealerships have denied to cover such things under warranty. The fact that your car is out of warranty makes this even more impressive!

yea seriously...ive been out of warrenty for like 2 yrs...and STILL they help out their customers as much as possible...im still in shock over this, i cant believe it, i cant WAIT to sign this contract and like frame it haha

definately keep a copy and pass one on with your class action questionairre as well, will be very helpful to those whose dealerships are less accomodating than JMK. Sadly they are the exception to service not the rule.
