Well, my car was found by the police! The drivers side widow regulator broken and window ajar, my new battery, 6 CD changer, and BMW tool kit missing, ignition was not damaged as the thief found the key under the seat.
Expansion tank empty, and the gas tank had a hose hanging out the fill neck. Body was not damaged. Car was towed by insurance company to a BMW dealer. They will do diagnostic and fix everything related to the theft, less my deductible.
Will give update on what they find.

hmm so the thieves only stole things from the trunk and some gas, not too much damage I guess.

Car theft is why I place a club on my car and have a kill switch running from the fuel pump to cut off all fuel. Its easy to run a switch from the pump motor to your dash console area
"expansion" tank empty... Wouldnt a blown engine costing 3k total it along with the door, cd player and such?

I would deny the claim just because the key was in the car. Not that I would want someone to suffer if it was in fact legit, but, thats second to the keys in the car and engine running, and, if I am correct, thats against the law in itself. Why should "my" insurance, in general and across the board, go up for such "key with car" Tom Foolery? I am already paying taxes for someone else,s kid to go to school and welfare line walkers

haha yeah well whatever. some people don't want to work so badly they take the time and effort to work the system to their "favour". There are people who need the system and use it appropriately, but then, there are some damn lazy people out there too. It's kinda funny to see the lengths some of these people go to, it would probably just be easier for them to just get a normal job I just wanna see how this turns out lol

Why is the shops insurance not paying for this? They are responsible for the car until you take possession again. If they are skimping out on this issue I would never take my car back to them. Maybe I missed something though.

Shops say that they are not responsible for theft or damages on the lot I do believe, so......
If the OP isnt going to make it interesting, I, as an american citizen (who doesn't capitalize america) hold it as my right to make this post as interesting to the public as possible to avoid stagnation and non interest of a BMW discussion board!
Shop can say that they are not responsible, but when they are negligent by knowingly leaving keys in cars as normal practice, you can win in court. Random break in not as much.
Ahhh, and here is where the vultures (being lawyers that is) step in. Was this a general practice for this shop? Wasnt it stated that in fact the keys were placed in the car upon the owners request? Lawyers love this stuff!

Any ever conisidered finding a shop like this and say, waiting for e36's and pulling the seats out, or even taking it somewhere, and swap suspension, and take it back?
