Got the letter this week.
What is the general opnion on the issue?
I checked with Mike of BMWCCA - his opinion was that the occurrence of such failure is VERY rare!!

As the result of a class action lawsuit settlement against BMW, the luxury German automaker will begin an inspection-and-repair process for potentially faulty subframes in fourth-generation 3-series models. The particular model in question is the E46, and covers the complete model run from 1999 through to 2006.
The suit originated in 2006 and claimed that defects in E46 3-series models cause fractures in the rear-axle supports in the subframe. Some customers have reported clunking noises from the rear and some have even experienced complete subframe failure.
This settlement only pertains to U.S. residents for now and is not classified as a recall of any kind. Details will be forthcoming, pending the court's final approval of the proposed class settlement. In advance of the final settlement, BMW customers with questions should visit the website www.E46subframeclassactionsettlement.com.
In the meantime, all E46 3-series owners and leases in the U.S. who have not noticed the problem or have already fixed it themselves should check the website as well as they may be eligible for reimbursement.

Interesting. I thought M3's weren't subject to this problem, just regular E46's.
I shall have to keep an eye out for a letter.

Completely worthless. In fact, what this really does is tie down BMW's liability going forward. If you don't have a failure by the end of the settlement period, you're SOL.

i got an inspection today and the inspector noted some rattling near the exhaust in the rear of the car when accelerating in 2nd gear. could the subframe issue be part of the problem?
while at my indy shop on the lift a took a look two tears on the right side. taking the car in tommorrow for inspection

I finally received the notice today.
Being that I am guilty of modifying the suspension and fitting more appropriate sized wheels/tires on the M division's (previous) flagship car, I'll stand on the sidelines.
Just kidding. I'll still drive the heck out of the beast.
Has anyone actually seen the issue? We recently reworked the entire suspension, front and rear, on my 99 M3 and when doing so, we welded some reinforcements into the rear sub... specifically, at the sway bar tabs.
I assume this is not the problem, but without pulling the diff and subframe, it's got to be a pita.
