Here are a couple dyno's of early E9x M3's who had their software updated to 213E by venders and netted 20+ HP!! This could explain why newer cars seem to dyno better than 2008/2009 cars.

Let me get this straight... You are swapping out parts designed by hundreds of engineers that get paid thousands of dollars for something you bought at Pep Boys because your buddy who doesn't have a job told you it was 'better'?!?
Yes, OEM software.
If someone wants it, the dealers will charge you, which isn't so bad (1-2 hrs), BUT if there's any damage to a module during the program, BMW will not cover it.

So the 21E software on '08/09 cars yields 20+ HP, does that mean the '10 please cars already have the 20+ HP or did they make other changes that brought us back down to 420 instead of 440. :

'10/'11/'12 have roughly 20whp more than '08/'09 with the only difference being software.
Applying the '10/'11/'12 software to an '08/'09 M3 yields 20whp gains.
I've also read of fuel mileage improvements with the newer software, so that's the angle I'm pursuing. My commute is 28 miles round trip. 26 miles of that is freeway at 70mph cruising speeds. Even with that, I'm only averaging 15mpg.
Taking it in the first week of May to have it updated.

Don't know yet. Once I drop it off, they're going to pull the current software version, which is the original from 2008. From there, going to submit a claim to BMW for a software update based on low MPG's, occasional sputters, etc. Hoping BMW will cover. My SA researched for a full week before calling me to set the appointment. I'll report back as to whether or not it's covered.

Recently purchased a pre owned '09 E93 M3. Had OEM alarm later installed via dealer (I miss the chirp). Install had reprogramming involved. I wonder if hours of reprogramming involved included this software update. Will have to investigate. Is software edition something they could just pull up on records? Thanks for the info!

The DINAN software would have to be updated too as no doubt it is based off the older 420hp model that BMW had in place.

I'm going to call Dinan about this.
Dinan hasn't heard of this magic update. They did say that they have to write a compliment file to every BMW update so after BMW installs their software, Dinan has to go right back in.

Another Dyno sheet. BMW left some power on the table early in the model run.
And it seems pretty hard to gain any power on a motor without taking out some cats.

Follow up on my previous post...
After jumping through all the hoops, the local dealer dropped the ball entirely. After waiting for an appointment, they came back and said they won't update the software even if I pay for it.
Since then, I've called up a dealer that's a little further away, but whom I've had great experiences with in the past, and I now have an appointment later this month with them. Should have just gone to them all along. The extra little bit of driving is worth the better service. It will be updated for sure 5/24. Hopefully BMW will pick up the tab. If not, I can pay to have it done.
Also found out my software is from 3/2008. So, this update should definitely put me in the group of folks who have picked up 20whp.

IMO, bmw should apply this update free of charge at the next scheduled maintenance. Hence, it's called an update.
