View Full Version : What are the laws in NH in regards to kicking out a roommate?
mikeyb74 03-12-2008, 12:08 PM I'm in a situation where I have a college student living in my apartment. We are not getting along what so ever. She is not on the lease and has never signed any papers. She does pay her rent and other bills. She does recieve one piece of mail a month there. Does anyone know the laws on getting rid of her? I'm desparate at this point.

Oh and if you do this now you probably owe here partial month's rent and partial month's bills. So leave a check and such.
I wouldn't worry about her coming after you at that point as you are not holding her stuff hostage and have reimbursed her whatever $$ it is that she would be owed.
Not the nicest way to do things but NH tenant laws are actually skewed to the landlord (which as a subletter you sort of are).
If this were MA that you were living in you'd be f'd.

I really do not want to get into that. She goes behind my back to the landlord about everything. He has told me that our problem is ours not his ad that she should not be talking to him. She needs to come to me then I go to him.

She paid for this months rent. But still owes me for her share of utilites. If I have to I'll eat it. I do have her security deposit that I could use for her share of the utilites.
I have a feeling she'll pull something. Because of the things she has been doing behind my back. The girl likes creating drama that is for sure. Which I'm not good at dealing with.

He suggest that I write her a 30 day notice to vacate the apartment. If she does not do that I would have to go to the court for a eviction hearing.

That would be funny! She actually came home three weeks ago all hyped up on coke and drunk. She was all in my face screaming at me. I told her to back off or I was going to call the cops.

I found this on roommate law:
If roommates are listed on the lease, each roommate is considered a tenant and each one will be individually fully responsible for the total amount of the rent due to the landlord, unless the lease specifically states otherwise. If only one roommate is listed on the lease and the others have not signed the lease, only the roommate listed is considered the tenant. The others are considered subtenants. Only roommates who sign the lease are responsible for the full amount of the rent to the landlord. The roommates who signed may have some separate claims against their non-signing, non-paying roommates, but such claims would typically be covered by contract law rather than landlord tenant law.
I also found this when searching for "roommate not on lease":
Your roommate would have the power to evict you only if you were renting from her, as a subtenant. In that situation, you'd be paying rent to her, and she, like any landlord, could terminate your month-to-month rental agreement with proper notice (30 days in most states).
Good luck, I've had my fair share of crappy roommates. I just bought a house, I am so happy I dont have to deal with that anymore.

Get it signed and stamped by a notary, I've done that in the past, it makes it look official. Also, send it to her registered mail so she has to sign for it. You wouldn't want her to say she never got it, that would be proof right there.
And.... get a lock for your room and keep and eye on your car, trust me on this one.

I knew I should have done that. The notary here at work has left already. I was just going to give it to her. If that did not work I was going to send it registered mail. I printed three copies. One of them I plan on giving to my property manager.
I'm getting a lock for my room and I park in a different parking lot now. She had no clue I came home last night when I did. She was waiting for me to get there. But luckily I was on the phone when I walked into the apartment so she did not say anything to me. I hate the feeling that I have when I go home. I do not want to be there.

There's a To and a From on a letter. Your name and address has to be on it, so the certifiication form can be sent back to you stating she recieved it.
