How successful are traffic lawyers? I got a ticket for going 49 in a 35:rolleyes. Any info or help would be greatly appreciated.

Two chances for trial by written declaration, and if that fails, supposedly you can still ask for traffic school? By the time you send out your first trial by written declaration, it would already have been around three months from the date you received the citation. It sounded good enough to me to give it a shot. I don't think 49 in a 35 needs a traffic lawyer. If anything, just opt for traffic school. And for all of them i did trial be declaration and i won and the ticket was dismissed. I have been recommending this for years. I had a friend get a ticket for 77 in a 45 and it was cleared. Basically when u get the ticket in the mail and it says appearance dat **/**/** what u want to do is 10-14 days before that date call in and request for an extension (u are entitled to one so dont worry) then when that day comes 10-14 days b4 that call in and request a trial by declaration. They will send you papers and what u do is write your part of the story of what happened. Then send it in but the Cop also has to send in a declaration but most of the time they dont because Cops get paid DOUBLE or something to go to COURT but they dont get paid for MORE PAPAERWORK. I called in for an extension but the clerk that I spoke to wasn't clear on extending the appearance date vs. the deadline for submitting the fine. They said I didn't even need to worry about the appearance date...:shifty AFAIK, if you miss your appearance date, you lose your right to contest the citation. So I just didn't take any risks and submitted my trial by written declaration 5+ days before the appearance date, didn't get an extension due to lack of clarity, and I didn't want to forfeit my ability to contest. I was under the impression that some cases were still granted the option for traffic school even after losing the trial by written declaration twice. I guess if your main concern is stopping the points from showing up on your record, and not financial costs, then a traffic lawyer wouldn't be a bad thing to inquire about. Sorry that I can't help you there. I thought you could only go to traffic school once a year though... I haven't got my courtesy notice yet though. It's once every 18 months, but that does not automatically disqualify you from a traffic school trial. |
