View Full Version : Thief - CAUGHT!
autowaune 11-04-2007, 04:17 AM 5 days ago, I bought a brand new camera, spent over $400. I bought this new camera to replace my last camera that was stolen out of my shop.
4 days ago I left my camera on the passenger side seat in my M3, parked in front of my shop, stupid that it was out of view from my office.
A so called friend (Ryan) stopped by my shop to order a part for his VW GTi, so as a "friend" I hooked him up on my cost.
After Ryan left, I went out to my car to grab my camera, low and behold it wasnt where I put it.
After looking all over my car and shop, I got fed up and decided to look over the surveillance.
Sure enough Ryan had walked up to my M3 to check it out for the first time, he first looked in through the window, then noticed that the door wasnt locked, he then opened the door and looked down at my nice new shinny camera, he looked around to make sure no one was looking (except for the 10 cameras), then reached down and grabbed it, walked it back to his car, then came in my shop to order his part.
I am not the type to resort to the police unless I really have to. As his part was 3 days out, he came back yesterday to pick up his part. When he came back, I acted all cool with him, just showing him some bs stuff on the computer. As I was distracting him, I had my mechanic look through his car for my camera, not to be found, my mechanic gave me the word that he couldnt find it.
So then I simply confronted him about it. I said "Ryan, you see that camera up there!?" "Its not fake..."
The look on his face was priceless, lol.
I then gave him 3 choices:
1. pay me for my camera
2. give my camera back, or
3. i will turn the video in to the sheriff the next moring
He basically chose #3 by denying anything to do with it.
I then had him leave.
Last night I drove by his house to get his address, then this morning I turned in all the info and video to the sheriffs office.
Some of you who go to Bertolinos Coffee Bar in Tacoma may know him, he is always there.

exactly! no parts for him, he still had the guts to ask for his part that he paid $60 for! Thats when I SUGGESTED him to leave...
The sheriff said that they wouldnt be able to do much about it them selfs, due to being "over busy with bigger things", but that all the info and evidence would be passed on to the county building where it would be "investigated" and passed on to the prosecutors office.
The sheriff told be that it averagely takes 4 to 6 months... as thats how long it would take before it would even be gotten to, behind every other PENDING crime investigations...
Thats our justice system. :confused

You could have just had your staff take the wheels off of his car until your camera showed up. It's your property. He wouldn't have the gaul to call the police after they heard your reasoning. Police HATE thieves.

Theft has nothing to do with small claims court.

He will eventually be facing the consequences, since its an item thats valued over $250, its considered a felony. It just takes the courts a long time to get to everyone. I may never see my camera again, but I learned that this person was not a true friend.
If this was 3 or more years ago, back when I still had anger issues, I would have beat the sh** out of him!
We all make mistakes, if it were me that would have made this mistake, I would have considered it really cool if someone gave me a chance to give it back.

I could do that, but I dont really care to devote an entire day over a few hundred bucks. $400 -cost of court costs = $300 plus the time I would have to put into it.

2 wrongs dont make a right, even if I were to do that, he could simply sell my camera and buy nicer wheels.

Any judge will look at him as a moron for not taking the other options that were offered to him in the first place.

True, but I really feel that he will be paying enough after he gos to court for criminal charges. Once you have criminal charges on your record, in this country, you are scared for life.

You had him by his balls and you let him just leave. You're probably never going to see your camera again and I'll bet that he's not going to even have his day in court.
So what if 2 wrongs don't make it right, it may have gotten your camera back and that's all that matters in this situation. It's either getting back at the douche for jacking your stuff or getting your stuff back.

Actually that would have been illegal to apprehend him.
I am very familiar with citizens arrest. I've done it before. You have to 'visually' see someone committing a felony act to be able to legally apprehend him/her. It has to be at the the time of the act, not after.
At the 'after' point, your only jurisdiction is to report the act/acts to the police.
I know this because, sadly, my mom is an FBI agent... fun in some ways... lol

When he gets charged, he will have to pay restitution. Which eventually will be paid to me via the state.

I actually ran into him the other day, I told him that he can come back to get his part that he paid $60 for, so far it seems that he hasnt had the guts to come back...
