Well I sold my S/C kit some old months back to one of the guys that works at Azevedo Motorsport. Deigo who is one of the brothers, front the money for it for his employee. He asked me to get it shipped out ASAP, so I dropped everything and removed the kit from my car that night.

Packaged everything up and had it out the next day. I sent it COD, and told him when I get the check I'd send the Software out, well it took a few days to get the moeny, and I asked him and marked it off on the COD paperwork has to be secured funds, he sent me a business check. So I held the sofrware til it cleared.

After he got the softare he called him while tryin to adjust the car and see if it runs properly asking me what HFM, I had, I told him I ran a 540i hfm, he said where is it. I told him if you read the thread, it plainly states it was not included. Original thread listed below.

He says wait I thought this was a turn key kit. When he said that I felt bad especially since I had so much respect for the guy considering of how many badass cars he has built in our BMW community. So I told him, I'd sell him one for 100.00 dollars, he asked if I could over night it.

I told him ok, he stated he needed it asap, and that he would put a check in the mail for me. I told him to sweeten the deal an make up for the misudnerstanding, I'd split overnight charrges with him.

So instead of a check for 138.00 just write me a check for 120.00.

Its been 5 months. I've called, he said oh I forgot its on its way. I sent pm after pm, I've sent text messages, I've left voicemails to the point where I don't get any replys from him anymore.

You know it goes to show, when it comes too money don't repsect anybody, dont' let you money out of your site, until you get what you purchased with it, or have away to protect yourself.

Diego SEND ME MY DAMN MONEY, and that is a check for $138.00 dollars. Not spliting any shipping charges with a person who is not a man of his word.

The original thread does say something to the effect of "everything needed" or 100% complete. However, the original thread also lists each part, and the 3.5" MAF is not on the list. It is easy to see how the misunderstanding came about. However, the time to deal with that misunderstanding was once the buyer realized that a 3.5" MAF was needed and not included. It sounds like both parties agreed to the resolution -- the seller gave up hos 3.5" MAF for $100 and splitted the shipping, and showed good faith by shipping before payment received.

By the buyers own postings here, it seems it is not disputed that the agreement above was accepted as reoslution to the misunderstanding. It seems the buyers position is that the check was sent, and thus washes his hands.

Was the check cashed? If not, then the check got lost in the mail or the buyers employee did nto send it. Don't you think it is reasonable to cacnel the check and send another, perhaps by certified mail? It doesn't seem like it should be the responsibility of the recipient to insure the check was received.

Is the employee no longer an employee and no longer reachable by the buyer? Well, if the agreement was made by the buyer on behalf of an employee, it is the buyers responsibility to make good on the deal.

Thank you, I never spoke to the employee, everything was done through Deigo who stated he paid for everything and the employee was paying him back.

If memory serves me correct, I was originally paid for the kit via a Azevedo Motorsports check.

Where is Diego? Hasn't responded with his proof of that check being sent. I wonder why!

I have to agree. The kit was advertised as including everything needed, but one chip was missing and it could not be installed without a 3.5 HFM. Could be a misunderstanding, but the seller needs to take some responsibility here. I think in this case that what Bisan has done in this forum and in other forums is inappropriate.
