I was cruising down Waialae toward the mall when I saw a camry with a blueberry on top of it flashing. I pulled over, shut the car off and waited.
The cop came up the window, asked me why I thought he had pulled me over. I said, I really didn't know. He told me I was speeding, did I know the speed limit...
I said yes, 25mph. He says correct, and I was speeding. I asked him how fast I was going. He says, "you were doing more than 35 down that hill, and you don't have to get smart"
he goes back to the car, (total ass this guy) and writes me a ticket... for "disregarding traffic control device" 97$. On the back of the ticket, he noted that I was speeding going "35+ in a 25"
NOT SPEEDING, because, as he noted when he pulled me over, he didn't need to have a laser to know I was speeding.
Normally I would mail this in, not think twice about it if I had actually committed the infraction, but I think is easily fightable.
So two things:
1) thoughts?
2) be EXTRA careful driving during the last few days of this month. This guy pulled me over for one or a bunch of the following reasons:
I'm white and driving a BMW
He needs to hit his quota
Either way, I wanted to let everybody know so hopefully our nice cars aren't targeted amongst the civics and Rav4s out there simply because we drive BMWs.

It's just a good thing I didn't have my HID fogs and angel eyes on. The guy probably would have had a coronary.

I figure I'm in good shape, considering told me he was citing me for speeding, then didn't check how he had measured my speed, and cited me for disregarding a traffic device....
Considering I make more than 97$ an hour, it sucks to have to go to court to fight this, but on principle I have to. Cops.... :mad

I fought a ticket, it was a BS pace speeding thing...Got a lawyer friend to continue the case until the cop died and failed to show for court.
If you have some vacation time and want to spank "da man" go for it.
If the Officer paced you, ask for the last certificate of accuracy on his odometer, distance paced..Etc.
elsVert 10-29-2007, 02:51 AM Not only did he not pace me, laser me or use a radar gun, he didn't even CITE ME for speeding.
Logically then, one would assume, he only charged me for something else because 1) he didn't know if I was speeding and 2) if I was, he had no way to prove it.
He pretty much eyeballed my speed, pulled me over, and gave me a ticket for unrelated offense.
I'm def going to fight it.

How fast were you going? Where was the 25 mph speed sign? Where was the officer did you see him behind you or did you pass him on a side street? What is the officers name?
On the pacing, all HPD personal cars go thru a speedometer certification once a year, and the prosecutor will ask for that.
On what the officer cited you for it is not what officers use for pulling speeders over. Traffic Control Devices are Stop Lights and signals not speed signs. I still have my Penal Code book at work, i'll be check the section tomorrow when I get into my office.
But I would contest the citation. Let me know on the answers to my questions, pm me if you feel more comfortable.

thanks for chiming in on this. When I noticed him, he he was behind me. however, he didn't mark pacing or anything else speed related on the ticket.
If there was a traffic signal, it was a light, one of the lights on Waialae. Again, he didn't mention anything about a failure to stop or anything else, he was talking strictly speed, and stated " he didn't need a laser to know I was going too fast".
I don't have his name, only what he scribbled on the ticket. I can find out his name, but basically you're saying that talking to me about speeding and then marking the ticket for something else is bogus.
That's what I thought. It only takes one bad cop experience. And it's not my first. I'll take two days off work to fight it if I have to, even if it does cost me 200 an hour.

elsVert 10-29-2007, 03:40 AM ID # is 100071 or 100077, I don't if that helps. He didn't like me asking questions... it was right out of law and order. Even my fiancee was tripping on the way the guy was acting.

Check your citation and see if this is the section he cited you under 291C-32 which is disregarding a traffic control device. This has nothing to do with speeding and is only applicable to stop, yellow and green traffic signals.
If he hit you under 291C-101 that is the basic speed rule which if conditions are bad such as flooding and you are doing the speed limit you can be cited under this section.
All speeding offenses are covered under the 291C-100 series in the Hawaii Revised Statues.
Sorry for the way you were treated that was uncalled for and that one officer gives all the officers a bad rap. I tried to treat people the way I would want to be treated and most of being fair with people.

The fact that he didn't tells you everything you need to know, he had no way of knowing how fast I was going and couldn't cite me for it, so he checked the traffic box and hoped I wouldn't notice.
I can't stand it when cops insult your intelligence. I have a few in the family, and like yourself, most cops are good guys. Like I said, it's also too bad that only takes one to screw it up.

Hey, i think I saw you in your car the other day. I remember the angel eyes/fogs setup. I was in a blue M3 headed from Kahala Mall area back to Waialae/Palolo but then had to go to Longs.

You may not have to. If you look at the citation, there is the option to contest in writing to the court. Plead your case as accurately as possible and mail it in with the citation (make a copy for records). The worst that can happen is they uphold the judgement against you, which you can request a trial date to argue in front of a judge. At best, they can dismiss the citation. Good luck with your case. :)

Read the citation very carefully.
If you go with the letter of contest, used photos diagrams etc.
and be advised....when I did this I could not appeal the Judge's decision....It was final:(
