View Full Version : Attention all E92 328i Owners who didn't get Sport Suspension
STE92VE 09-20-2007, 11:57 AM If you purchased/leased a 2007 E92 328i and it was produced between 3/1/07-4/17/07, you probably have the standard suspension components and not the sport calibrated suspension as advertised.
The proper suspension can not be retrofitted and BMW offered a $200 gift cert to be used for online purchases of hats and shirts. This is an insult.
A lawyer suggested bringing BMWNA to small claims court if a satisfactory resolution can not be reached. Who else is affected and wants to join me?

Do you know how I would go about finding if a class action suit has been initiated?
So sports suspension was listed on the sticker, and it in fact did not have it? Wow.
Seems like they should provide you a new car with sports suspension and take back your car with no out-of-pocket cost to you.
The sports suspension was not listed on the sticker but neither were fog lights and we all have them.
Wow. That's a really big slip up.
I'm curious as to why they can't retrofit the sport suspension. Outside of shocks/struts, springs and sways, I can't really think of anything else for retrofit. Are the suspension geometry and pickpoints are different on the sport suspension as well as possibly different control arms, bushings, etc?
A $200 gift certificate is definitely a chintzy and insulting offer to make amends.

I guess you posted as I was posting the above. I think they won't retrofit as a fact of decision not capability. Perhaps as this issue snowball's and they find that a $200GC is not appeasing the public, they will succumb to pressure and concede to retrofit the correct suspension. FWIW, I'm OK with the way my car handles for the Metro NY roads. But that isn't the issue here.

I agree about corporate decision as that would be a costly mistake to fix. But you are right-it's not the issue of the suspension being adequate. That's not what you paid for.

Oh, the $200 GC was the way they THOUGHT they were going to address it. I had contacted my CA and he was unaware that there was an issue so I'm betting that there were those that bought these cars after BMW knew about the problem. I don't think the word "fraud" would taste very well in BMW's mouth.
Don't get me wrong, I have not soured on the BMW brand. I love my car and as far as the handling goes, for Metro NY, it's fine for me. But unfortunately, that's not the issue here.

Oh I understand, you have every right to be upset. No one likes to get less than what they expected or been led to believe, although I wouldn't go as far as calling it fraud since BMW acknowledged it was a mistake and informed dealers about it, it is unfortunate some dealers are clueless but happens. That being said, the GC is definitely not enough to appease anyone serious about the Sports suspension. Short of a retrofit though, I am curious as to what would make you satisfied. I am not sure if I were in your shoes I'd be satisfied at all, but upgraded OEM wheels come to mind, extended warranty (say 2 years) is another.
