I get a rear end twist when im passing cars or if i lay into 2nd gear, the car is going to get aligned but i think it is something more serious, what should i look for a E46 m3 should feel solid in the rear, mine feels like it walks left to right driving in a stright line on bumpy roads ?

What you are describing are the symptoms of worn out RTABs. My car started developing the same problems at about 33K miles. I replaced them with Rogue Engineering RTABs and adjustable rear trailing arms. Below are some pics of the RTABs and ARCAs installed.

I agree with what Bob is saying. BTW, how many miles on your '02?
I did the RTABS on my '02 @ 37,xxx, the old ones were a bit worn. Big difference with the new RTABS, car feels planted and more enjoyable!

OE RTABs have been updated (part taken from the new MCoupe actually). They are using a new design with different rubber from what I understand so they should hold up longer. I'd probably get some Ground Control shims and toss them in also since that will reduce the movement and wear.
RE and Powerflex make polyurethane ones but some people say they are noisy and you need to lube them up with copper antisieze.

yeah i will prob go with the one above, how necessary are the ARCA, and shims ? anything else to replace while im back there
