Sudpud 06-12-2007, 09:24 AM So after hanging out with some friends for a couple hours i decide its time to head home (approx. 12am). As Im heading down 10th street and turn right on Monroe, I see the dreaded blue and reds in my rearview. So i pull over on Virginia Ave. and wait til the cop approaches. He walks up to my window and informs me that he lasered me at 50 mph in a 30. Before i have time to despute this, he procedes to tell me that he smells alcohol on my breath( i hadnt been drinking). Which i firmly deny. So he tells me to get out of the car. I comply and he makes me blow into what he called a preliminary detector. Suprisingly(to him at least), i pass the test. All he says to this is "well i still smell it on your clothes then". He then procedes to tell me to get back in my car and he walks to his car. He writes me a ticket for 50 in a 30 and when i question him about where exactly he "lasered" me from, he gets defensive and says "if you want to know that, go to court". The most BS part of this entire story is that 10th had traffic on it, and there was no way i was going above 30 (i diddnt believe i was going faster than 20). Long story short, does anyone know what i should do about this? It was city of atlanta PD, and ive gotten tickets but have always gotten them dismissed, but that was dekalb county...not City of Atlanta. Should i fight it? I think i should, but maybe someone in this forum will know more about CoAPD. It doesnt suprise me that some dirty cop was fishing for DUIs, but why did he have to pick me. My last car was a silver g35 coupe and i never attracted any attention, is this random or do cops target black BMWs?

Yes they do. Had a cop pull me over RIGHT after he pulled over an all blacked out Suburban. He had him pulled over in a gas station lot, then as he was done with him he saw me and immideatly flipped a bitch and went after me. He followed me for a good while till he turned on the lights n sirens, pulled me over for my blinker not being "amber enough". Needless to say he let me off with a "warning" which is just a coverup story for him fishing for something worse.
I cannot offer you much advice for your area but if the cop says he lasered you at 50mph that means he should be able to prove it in court. If he cannot, then you might be able to turn this in your favor.

I won't speak to the rest right now, but this did catch my attention due to my own experiences. I've owned three E34 535's over the past ten years: a white one from '97 to '00, a black one from '00 to '03, and a silver one from '03 to present. Mods have basically been identical on all three cars, and my driving habits remained constant. At one point or another during the ownership of all three cars, I had the appearance of some long-haired punk, and at other times I appeared as respectable as it is possible for me to appear. Basically, the only thing that changed was the color of the car. The results? I was never pulled over in the white car, I've been pulled over one time in the silver car, and I was pulled over five times in the black car. Only one ticket was issued as a result of all of these police-citizen interactions, but I still found it interesting that the black car drew more attention than the others. I can only imagine that I'd be in jail somewhere right now if I had owned a red car.

Sudpud 06-12-2007, 10:33 AM Well ive checked into the matter some....in georgia you cant use a speed detection device within the first 300 feet of a school zone...(i got pulled over right by Grady HS and the Children's School) and you cant use speed control devices on a grade of 7% or higher. 10th street is downhill on that section but i dont know the grade or anyway to find out. Well ill drive by there tonight to see if i can get some evidence. Im really getting tired of the Police right now- My housekeeper's son just got convicted of murder when all of the witnesses admitted they could not Id the man who did it. As much as i love Atlanta, the Police are terrible and jerks (thats not to say I havent met the occasional really nice one).

I can guarantee that 10th street isn't a 7% grade. Mountain passes are lucky to hit 6%, so yeah...

Jerry 745Li 06-12-2007, 11:58 AM I don't know how it is in Atlanta, put up here in Pennsylvania they use a point system. Collect enough points from tickets and your license goes away for a little while. You always take a hearing because you have nothing to lose. DON'T expect to get the ticket dropped, rather try for a compromise. I always try to get the points eliminated but pay the fine. By dropping the points you lower your risk of losing your license and you also lower the risk of your auto insurance from increasing. Again, all this appiles to PA, not sure about GA ticketing system.

My black '84 745i, on the other hand, got stopped all the time. Gangster tint and lowered black 745i rolling through Roswell seemed to give the local constables the fits. I got stopped for having an obscured tag sticker on the license plate. He actually wrote the ticket and I had to go to court over that. The judge threw it out. What a joke.

Since he wouldnt tell me where he lasered me and shut me down when i asked if he could use it while moving by saying "ask in court". I should be able to get it dismissed. But, who knows what the judge will do, so i am trying to DECIDE whether to trust that justice will be done, or hire a lawyer and spend money to better my chances of justice getting done.

Now I'm not saying that this would happen, but hypothetically if you say tell your story and the officer comes to court, and he denied it, the court will believe the officer, and you'll lose.

I'm not sure who you heard this from, but it is another old wive's tale. He has to provide all of that documentation at the hearing, but he doesn't have to show it to you on the side of the road. I don't know why people think that...

In depends on the state. In Georgia, not wearing your seat belt is a primary violation, which means there doesn't have to be any other violation for you to get pulled over. In other states, it is a secondary violation.
Those aren't the legal terms, but they are better terms to use to describe the situation.

ive only had to pay 1 ticket in city of atl. everytime ive gone ive plead not guilty, kept going, brought up every technicality i could find, and esp for speeding where you were, bring a map showing where the officer said you were, note traffic conditions and how it would be impossible to obtain that speed, etc, seriously waste their time enough and the judges always realize its not worth the 200$. ive even requested a trial by jury for an 88 in 55 on 75/85 beside tech, solicitor deaddocketed it as most of my charges have been. srsly = waste their time as much as possible. and every atl judge ive had will drop it if the officer doesnt show up, only probs ive had are twice the officer didnt show up then they rescheduled it but the rescheduled date the officer didnt show up, another time he was in the building but not in the courtroom so the judge let me and 3 other people off, he walks in as we walk out and wasnt happy but im not complaining.

Just kidding I have only had one run in with the law in GA. That was after being in the state for all of 4 hours. But other than a huge fine and community service I am not bitter. Now come to my parents neighborhood and area in NC. A black man in a BMW or MB will get pulled over at least twice a week. TRUST ME I KNOW FIRST HAND. Sometimes they are nice enough to follow/escort you home to make sure you got home safely/YOU ACTUALLY LIVE IN THE NEIGHBORHOOD.

And if you didn't, did he happen to ask you if you wanted an accuracy check? Some jurisdictions are required to ask you if you'd like an accuracy check. But it pretty much sounds to me like he pulled 50 in a 30 out of his ass. I would try and fight it.

Walk this line , touch your nose, ABC's frontwards then ask's me to do my ABC's backwards to wich I replied " FUDGE man Just give me the Breath a liser, I am tired and wanna go home" I still got the ticket for speeding.

WytLytnyn 06-13-2007, 09:03 AM In VA, they tend to pull you over for seatbelts, tinting, bumper height (on 4x4's), going more than 5mph above the speed limit and then conduct a "safety inspection" to see what else they can nail you on. Also, if you're crazy enough to run a detector up there (illegal + big fine), it had better be off and behind the driver's seat.
I haven't heard of that around here with the exception of Halston when the tow guy jumped in his M3 and hauled azz to the impound lot.

This morning as i was driving to take my car to Auto europe to fix the PS pump, I took a left on Piedmont Circle instead of coming from monroe like i normally do. Well this lifted jeep blocked my view of the no left turn from 7-9 and 4-6 sign. And I made a left. This is my fault because I always drive there and i seen the sign before, but it was early and i wasnt thinking. Well as soon as i turn i see these moto cops in the parking lot next to auto europe and i get a ticket for illegal left turn. They got me and like 3 others while i was there. This was my fault, but i hate how ATL PD would just sit in a parking lot and give out tickets instead of busting crack dealers. I pay their salary with my tax dollars and i cant stand it when they do stuff like that. Jack told me at AE that they are there every morning. Wow, thats what i want all my policeman doing.
