While searching around for the best rates on the refinance for my newly constructed home I decided to give LendingTree.com a chance.

Turns out they offered a pretty good rate. 5.99% while paying 1 point. After pulling my credit my mortgage banker told me all I needed for verification for the loan was a VOE, verification of employment. To be filled out by my family business. I told my mortage banker that I was all for it. I had to pay a $600 "nonrefundable" deposit for locking in my loan rate and getting the ball rolling. This seemed fair to me. Afterall, they must get an appraisal of my property/home, that alone can cost me $250-350....Did I mention that I had been approved for the amount requested for the loan based on my pay/job status(10+ years of employment with the company)/credit.

I pay the deposit with a creditcard and sign a form allowing tree.com to proceed with gathering information for the loan.

Our business recieved the VOE and the president of the company, my mother, filled it out and had it faxed back to tree.com. Oops, some of the info was inaccurately reported. Bonus pay, salary, commission pay was all over. So I contact tree.com via phonecall, as all business had been handled and told my banker the situation. He said, just send the corrected VOE w/ a letter from the president noting that the first copy was sent in error. So we did. As we did I also recieved more pay seeing how between the first and second copy I got paid.

2 days go by and I got a call Friday telling me my loan has been rejected due to the VOE's not being the same :rolleyes and they go on to say some other completely non-relevant shennanigans....like how they think the president of the company and I are in some kind of relationship(she's my mother, d'uh)...when I say non-relevant, I mean it has nothing to do with anything.

I ask to speak with someone about this and getting some kind of possitive result from this whole headache. I don't reach anyone until today. I speak with my bankers superior. She tells me there's nothing they can or will do for me. I related how I was told I would be fine as long as I sent a letter from my employer explaining the first VOE was sent in error and sent another corrected copy. She said it wasn't good enough.....:shifty "What do you mean it's not good enough? I did exactly what was requested of me" :mad

To make a long story short. I asked point blank if anything would be done to make this happen. She told me that nothing would happen and this was closed.

Should I charge back my cc? Can they do that legally?

The loan isn't a issue. I was already approved for my loan from a local bank at a reasonable rate. It's more a matter of them pissing me off stealing 2+ weeks from me and I honestly don't feel they deserve the $600.

I used Lending Tree to refinance my home. Took them over a month to process my paperwork because some dumbass didn't feel like processing my application. It took repeated calls to his supervisor to even get things moving. I will never use them again.

It seems like the $600 was paid to lock the rate which was never delivered by tree.com

I say charge it back since they did not stand behind their agreement.

do a charge back, worst case they will spend far more than 600 proving their case...or sue them in small claims court, just picture the cost involved for them to defend themselves vs. simply paying you off.
