The general consensus of opinion among Bimmerheads (I believe) is that BMW overstepped their bounds by claiming `lifetime' transmission fluid. You will see more and more folks taking their vehicles in to have the fluid changed, and some on this forum who have done it themselves, some not as successful as others.
There was an issue of Bavauto's Fast Times where they tore into BMW and their 'false' claims of lifetime fluids, and you can find it on their site, along with some really good articles, if you care to look (and read).
It will not hurt to change the fluid, but remember to use the specified fluid and filter, especially the filter....and if you choose not to do it yourself, have a competent independent do it, or as a last resort, take it to a BMW shop. It can only benefit your car (If in fact you decide to buy it).

Not really. 12 years and i have never changed the fluid.

i was also told that because the car has so many miles and has never been drained before that if i drain it now i could end up flushing out some gunk that was previously holding the shattared remains of the gears together and the trany would be ruined

instead of just a tranny filter/fluid change, maybe a full blown tranny flush. Also read about what crewdog mentioned about BMW's lifetime fluid position which has now been reworded to "extended"

if I understand a flush correctly, almost all of the old tranny fluid (including the T/C) is completely evacuated from the system (and with it, the crud/gunk). I have done fluid/filter change only (drain pan, change filter, top off) for both my trucks and they have been problem-free for 3-4 years now.
I intend to do this for my 7 as well (currently has 75K miles) at around 100K
