View Full Version : Need legal advice on a ticket :(

Someone hit my bimmer today and dipped out... so needless to say I was pissed. :mad :(

Anyway, on the way to drop my friend home off, I passed by a cop. I pulled into her neighborhood at the same time her mom, and a cop behind her did.

He got me out of the car, and told me I was doing 71 in a 45. Her mom asked if she could see it on a radar, and said he coudln't show it to her. I'm going to assume he has it on radar, but who knows.

I'm 17, am I looking at loosing my license? I've got a good job and enough money to pay the ticket and a lawyer. It comes out to 26 over, and I thought you got arrested at 24 over?

I didn't have proof of insurance, but he ran the VIN (I guess).

So, what kinda payments for the ticket am I looking at? Am I going to loose my license? I've only had one other ticket in my life, and that was for following too closley... and I didn't get any points. This was almost a year ago also.

If there's any lawyers on the board that can really help me out, I'd appreciate it, and pay them (providing they gave me great advice).

Sence it was a gas station they should have cameras, but i'd find out quick if they do b/c they wipe them every couple of days. And if the cop refused to show you the radar then you can dispute the charge because of some clause (I'm not a Lawer so i dont know what it is just ask, and say he refused to show you the radargun) And you dont usually lose your liscence on the first offense, unless the judge is a complete and total ass.

if YOU request to see the speed indicated on the radar gun, the cop HAS to show it to you. Not only that, but you also have the right to ask him to "test" the radar. He will have a set of tuning forks in his cruiser. Each tuning fork will display a certain speed after being struck and placed in front of the gun.

I have gotten out of more tickets than prolly any 10 of you combined have received.

another good technique is to postpone your court date a few times. try to find out what days the officer work and doesn't work and try to have a court date scheduled on one if his days off. you can do this by calling the police station randomly and asking for the office by name.

also, when you get to court, ask for the certificate of calibration. the radar has to be calibrated before each shift. if he does not have this certificate in hand in court, the judge will dismiss the ticket.

like I said, these change from state to state.......but your attorney should be able to inform you more. I would definately fight this as it sounds like he didn't clokc you.....

No, you will not lose your license, but in Virginia, that would qualify as "Reckless Driving," which is a major charge. In fact, it might even be a misdemeanor in some instances. You're looking at major points, traffic school, and maybe something in addition, e.g. a huge fine. Oftentimes, they drop the fine if you successefully complete traffic school, but only on your first offense. That's probably just Virginia-specific though.

The fine depends on where you got busted.

City of Atlanta = BOHICA
Fulton = pricey, but suprisingly affordable.
Cobb = pretty cheap. 74 in a 55 (to quote the officer, "I'm going to write you up for 74 in a 55, but I think we both know you weren't") cost me $170.

As for the points, you're in the reckless zone, but should be able to work something out. Hopefully the officer won't show.

If it's City of Atlanta, there's also the chance that he won't even turn in the ticket. I got nabbed 83 in 55 and the ticket never showed, even when I renewed my license.

In GA, under 18, I think, 25 over is mandatory 6 month suspension.

I got a 95 in a 55 when I was 17, but thank god that law wasn't around then.

Oh, wait... they still suspended my license... :cry

See, I'm kinda looking for GA specific laws/rules/etc. I've heard alot of conflicting stuff. What are the chances a lawyer can get it reduced to 23?

I also already have a court date... January 17th or something.

Funny thing is I didn't really even think about the ticket till I got home, cause I was so pissed about the hit and run.

The cops are aware of how it works, if he wanted to, he would have made the ticket for under 25mph and saved your license. He didn't want to.

You need to get a lawyer, and, that's most of what you can do.

Can I get a lawyer that can somehow drop a few MPH off the ticket? Thats what I was told by a few different people today. Im only 3mph short of not losing it. I'll pay for a lawyer, I have a real good job and do alot of side work (yard, automobile, sell cars, sell electronics, etc). If I loose my license I will be screwed for all these, not to mention I want to keep it.

In other words, it's worth it for me to pay a nice chunk of change and keep my license than loose it. So any good lawyers that KNOW what they're doing on here? Anyone have any good one's numbers?

Before you go before the judge you have a chance a plea. You plead guilty, save the state the hassle of hearing the case, and they mark a few miles an hour off the ticket.

Honestly, once your insurance company sees a speeding ticket for 24 over, they will be your new biggest problem. $$$

I got pulled over in Fulton for 76 in a 55-$240 ticket. I went to court talked to the officer and got my speed lowered to only 14 over and my fine was $110. On the other hand I was pulled over on Highway 41 doing 100 in a 45 zone and got away with a warning, and another time I was doing 60 in a 35 and got away with a "just try and keep it around 40".

You absolutely need to hire an attorney. He or she will get it all worked out for you, especially if your record is as clean as you say.

Unfortunately, I don't practice that type of law, so I can't really help you out.

Thats a big no no. With a good attorney you might/should be able to get the charges dropped.

you should be able to get a lawyer and cut a deal with the prosecutor, and get it down to a few defensive driving classes, some community service and a fine.
I got a ticket for agressive driving (usually 6 pts) and am 17: got a deal for 5 driving classes, 20 hrs community service, 200 Dollar fine (which can be reduced/eliminated via extra community service) and no points or anything on my record. I pleaded Guilty with TLC [Teens Learning Control] (available in the City of Atlanta only as far as I know).

My record's not TOO clean. I've got a following too closley. I've had other charges when I was 14 and 15 (not driving), but that was a long ass time ago, and none of them ever went on my record.

Ok, when I got my first speeding ticket, I was 19. I was going 69 in the 45, 24MPH over the speed limit. In GA, if you are doing over 20MPH over you'll lose your license unless the judge reduces it or the cop reduces it.

Get a lawyer... or ask a lawyer for advice.

It was my first ticket and I had a clean record so the judge reduced it to 20MPH over and I got a $180 fine.

Where did the cop clock you at?

i dont see why youd lose your license. ive lived in PA and now SC and ive gotten numerous speeding tickets. From 15 over to even 40 over and i still have my license. I just got a huge fine and the points. i got my first ticket at 16, 2 weeks after getting my license, going 25 over and i still got to keep it.

but abuse the radar gun...the officer MUST show you the gun if you ask to see it, you have a witness to the fact that he didnt...i have used that ploy more than once myself...

and the above comment about the calibration ticket, if the officer doesnt show it, you walk away without a ticket and its a glorious thing...

a lawyer, or at least SOME sort of legal counsel is the way to go...there are ALWAYS ways out of a ticket...some paperwork somewhere that didnt go exactly right or something...

i got out of a ticket because the officer used the wrong paper, and another one because his writing didnt press through to my copy of the ticket...fight fight fight!

It is NOT law in GA they must show you the radar reading OR gun. The only thing they are required to do/ask is if you want them to test the radar. YOU do NOT get to see this test. It also does not apply to state troopers, only local cops.

In fact, I would love to see written proof that this is law in any state. Most will not even let you out of your vehicle during a stop.

Having been to a traffic court a time or two, best advice is to get the lawyer who has the closest office to the court house. he will most likely have the best contacts to get it dropped or reduced. Going to court to fight is a gamble at best. Even if u have the law and OJ's lawyers on your side, the judge can side how he pleases. your a kid vs a paid professional, its not rocket science as to who they side with in most cases.

I went to most every court in suburban and downtown Atlanta at some point in my teenage years, and the only time I "won" was based on a complete and total misunderstanding that I was perfectly fine with latching onto. Most of my elaborate theories never saw the light of day.

When you are in court. Just check out how much deference the judge gives the cops. It would :rofl if it wasn't so :(.

Instead of trying to get out of this with a decent portion of your ass left, be a man and pay the fine. You were man enough to do the speed. You knew the consequences if you got caught. Between the ages of 18 and 20, I got 2 tickets for 80 in a 55, driving on a suspended license, no insurance, failure to appear in court, and had 2 warrants for my arrest. What did I do? I ponied up and it cost me $2800. Stupidity is expensive. By the way, that was 17 years ago and my license is clean. My insurance does not cost me a fortune. You can get over this.

I'm not scared to pay the fine, I've got a good job and have the money. I just don't want to loose my license.
