jeepster 10-23-2006, 04:15 PM I got a damn ticket in my wifes mini for having to dark of window tint.:mad I read all the laws, and know what is legal and what isn't. I want to know if anyone has fought this and how to do it. Do I need to have the car inspected at the cop shop to see if the tint has been removed? Can I just provide a receipt from a shop that "says" it has been removed? Worst case scenario, I get a Doctor to srite me a scrip. that says Im light sensitive and then I can do whatever the hell I want in the back windows. If I have to have the tint scraped, is there a good shop that will remove it, let me get it examined, and then reapply it? thanks. Oregon cops are douches.

stang65 10-23-2006, 04:40 PM how dark is the tint. kinda weird that you would just get pulled over for the tint unless he was wanting to take a look at the inside of the car.
boarder325 10-23-2006, 08:18 PM The same thing happened to my Dad in his M5. He was at a stoplght and got pulled over for no front plate and dark tint. I believe the limit is 35% (correct me if I'm wrong) and his were 29%. He got the plate ticket dropped, but just payed the tint one and never removed it. The ticket was just as much as getting lighter tint and removing it was "not" and option. I say just pay it. My Dad hasn't gotten pulled over for a couple of months now, your was just bad luck.

jeepster 10-23-2006, 11:25 PM Our tint is way dark. Mine and hers are both at 12% net (15% film). OR law says 35% net which equals about 40% film all the way around. Crappy in my opinion. removing the tint is NOT an option for us either, but I'm a full time student at WSCC, my wife is a preschool teacher, and our savings really don't want a $242 hit on it for just paying the ticket. Here is the law as revised in 2003. Does anyone know what the old law (back in '95) was before the revisions. If I install skid plates and have a tow hitch, is that sufficient for the MPV rule "occasional off-road use"?
815.221 Tinting; authorized and prohibited materials; certificate. (1) Notwithstanding any other provision of law, a person may apply tinting material to the windows of a motor vehicle in compliance with this section.
(2) Tinting material may be applied to the side and rear windows of a motor vehicle if:
(a) The tinting material has a light transmittance of 50 percent or more;
(b) The tinting material has a light reflectance of 13 percent or less; and
(c) The total light transmittance through the window with the tinting material applied is 35 percent or more.
(3) Tinting material that has a lower light transmittance or produces a lower total light transmittance than permitted in subsection (2)(a) and (c) of this section may be applied to the top six inches of a windshield. Tinting material may not be applied to any other portion of the windshield.
(4) Tinting material that has a lower light transmittance or produces a lower total light transmittance than permitted in subsection (2)(a) and (c) of this section may be applied to all windows of a multipurpose passenger vehicle that are behind the driver. This subsection applies only to vehicles that are equipped with rearview mirrors on each side of the vehicle. The windows as tinted shall meet the requirements for AS-3 glazing material established by federal regulation. For purposes of this subsection, a “multipurpose passenger vehicle” is a motor vehicle with motive power that is designed to carry 10 or fewer persons and is constructed either on a truck chassis or with special features for occasional off-road operation.
(5) Tinting material that has a lower light transmittance or produces a lower total light transmittance than permitted in subsection (2)(a) and (c) of this section may be applied to the side and rear windows of a vehicle registered in the name of a person, or the person’s legal guardian, if the person has an affidavit signed by a validly licensed physician or optometrist stating that the person has a physical condition requiring window tinting that produces a lower light transmittance than allowed by this section. The affidavit required by this subsection shall be kept in the vehicle and shall be shown to a police officer who inquires about the tint.
(6) There are no light transmittance requirements for glazing materials applied to AS-3 type windows.
(7) The following types of tinting material are not permitted:
(a) Mirror finish products.
(b) Red, gold, yellow, amber or black material.
(c) Tinting material that is in liquid preapplication form and is brushed or sprayed on.
(8) Each person who installs window tinting material in compliance with this section shall give the person who requested the installation a certificate stating:
(a) The name and address of the person who installed the tint;
(b) The light transmittance of the tinting material;
(c) The light reflectance of the tinting material; and
(d) That the total light transmittance through each window with the tinting material applied is not less than 35 percent.
(9) The certificate issued under subsection (8) of this section shall be kept in the motor vehicle and shall be shown to a police officer who inquires about the tint.
(10) Prohibitions and penalties related to the standards established under this section are provided under ORS 815.222. [1995 c.263 §2; 2003 c.158 §8]
815.222 Illegal window tinting; penalty. (1) A person commits the offense of illegal window tinting if the person applies window tinting material that does not comply with ORS 815.221 or applies window tinting material to a window of a motor vehicle that is not authorized by ORS 815.221 to be equipped with window tinting material.
(2) A person commits the offense of operating a vehicle with illegal window tinting if the person operates a vehicle registered or required to be registered in Oregon that is equipped with window tinting material that is not in compliance with or authorized by ORS 815.221.
(3) Each offense described in this section is a Class B traffic violation. [1995 c.263 §3]
ScottyFerrari 10-23-2006, 11:56 PM I'm gonna take some crap for this opinion, but I think venting all your anger on the cops is misplaced. They didn't write the law, and their charge is enforcing all laws. Individual decisions about what to enforce=something close to anarchy (please don't go all political science on me and point out this isn't exactly the correct term--I know).
Could they spend their time enforcing more significant issues--sure. Was the cop who pulled you over bored--maybe. Did you do something to attract the cops attention in the first place?
I'm waiting for my first no front plate ticket. I will be pissed (and likely won't be able to help directing a little of that at the citing officer) but ulitmately I know I need to direct that anger at the legislature.

when i got my car the first night i got pulled over cuz she couldnt see my temp plate in the back window cuz the tint was way to dark and she just said to put it in a better spot. i got 10% tint too. so i dunnoooo
jeepster 10-24-2006, 11:43 AM At the risk of sounding racist/biased, I think that writing this type of ticket should be up to the officers disgression. I understand that tint laws were put in place for police safety; so they can see the occupants actions while approaching the vehicle. So I guess that Im trying to say that if you see a peice of sh*t 88 corrolla with limo tint (might be a little suspicious), write em a ticket cause its not there for the look of the car, but if there is a nicely dressed, respectful, inteligent couple in a BMW, I doubt they are any concern for safety;more likely, the tint compliments the look of the vehicle. Im gonna try to get an optometrist to write me a note for light sensitivity and see if that works. Just and FYI Oregon is the only state that I saw that it is 100% legal to write a tint ticket to an out of state vehicle/driver.
