Driving back from the sticks, huge ass wreck, guy wrapped his SUV around a culvert, died.

So we pulled into the walmart because all the cops had shut down the road we were on.

Cop pulls up, runs his mouth claiming up and down we caused some accident where we werent even around at the time.

So he writes all of us a ticket for MIC. I asked the cop to breathalize me and he wouldn't.

Since he has no evidence to form a case (breathalizer etc) how easy should this be to get off.

Anyone got good lawyers for over zelous moron cops?

3 "drinks" for someone about 175lbs = .075... which is drunk enough for a legal MIC and almost for DWI (though with the zero tolerance for underage you should thank whoever it is you pray to that all you got was an MIC)

I didn't get pulled over either! We were in walmart parking lot having a cigg. and the cop rolled up and claimed we were involved in teh accident, it just prepuated from there.

Question allready got answered, Trooper told me to just tell them jurisdiction.

He can't cite you for DWI, or Public Intox, and because you didn't consume brews on his turf, he can't write ya a ticket.

I am luck he didn't throw my ass in jail, I technically did get off scotch free, he just gave me a bunch of red tape to run thru which I don't think theres any less of a punishment I could of gotten.

Jetter your a dumbass. It may be a pussy thing to do, but I go by one beer = one hour I will not be driving. Not because I'm afraid of crashing, because personally, I could drive home after 5 beers in an hour and do it safely. But, I a scared shitless of getting pulled over and being 18 with alcohol in my system. I don't take any chances. I usually wait an hour after I feel any effects of the beer, just so I know I don't have much, if an alc. in my system.

You may have been sober to you, but to the law you were drunk. You weren't driving? Or you were? I still don't know. Anyway, you should be fine in my opinion. He has no proof whatsoever that you were intoxicated. Also, he also can't legally give you tickets like that. He has to have a reason to do so, and he has to test everyone. I bet everyone gets off but I don't know if it's the same where you are. My buddies got pulled over drunk high with weed and opened beer in the car and the cops searched and tested them all.
