would these fit on my E39 530 without having to midify anything, and without any rub?

No...they will not fit without modification.
First, the e39 is the BMW wheel oddball...it has a 74.1mm wheel hub whereas most other (and all other modern BMWs have a 72.56mm wheel hub.
Second, the 5/6/7/8/Z8 series have compatible wheel specs (except for that E39 wheel hub diameter):
72.56mm wheel hub
5x120 wheel bolt pattern
10mm-28mm offset range (the newest 5/6/7 series have a few staggered wheel set-ups that have rear wheels with offsets as high as 32mm)
...the 3/Z3/Z4/X3/X5 wheels have a wheel offset that ranges between 35mm-48mm which is too high for the 5/6/7/8/Z8 models...although some of the other specs are compatible like the 5x120 wheel bolt pattern and 72.56mm wheel hub.
There are always exceptions...like the e30 M3 & e46 M3 have some wheels that fall into the correct offset range. For instance, the chrome M3 wheels listed in this thread...they're staggered, and the rear 9"x19" wheel has a 26mm wheel offset...so if you had an e34 5 series or the new e60/e61 5 series...you could use the rear wheels because they fall within the correct offset range of 10mm-28mm. The front wheel (posted above) has an offset of 47mm which is too high for any 5/6/7/8/Z8. You can see the wheel specs by going to the online parts database or the BMW ETK Parts CD...here's a direct link to the diagram: http://www.realoem.com/bmw/showparts.do?model=BL93&mospid=47714&btnr=36_0426&hg=36&fg=15
