About a month ago I bought 99 540i w/ 155,000 kilometers.

Well I had issues with the car, went back to the dealership 5-6 times. Then last week local mechanic told me the frame of the car was bent, and that he thinks the car was in an accident.

I called dealer and at first he denied it, but when he saw I was serious about taking him to court (he never told me car was in an accident) he offered me a full refund, plus he'll pay for a few things I had done since I got the car (cleaning, buffing, oil change etc.) totaling $1250. Looks like I'm taking it back tomorrow, so now I'll be looking for another 5er, probably a bit newer.

I forgot one thing, what could cause white smoke (a lot of it) when starting the car? Not while driving (only sometimes at WOT)?

def take it back. if they offered to refund you they know how fucked the car must be!

I was supprised by their offer, so fast. They offered full refund on Monday and it was good til yesterday, I said no right away and said I will take them to court, then they emailed again saying they'll pay for all repairs I had done and extended offer til Monday, so I'm taking it back.

could be a problem with the head gasket.

Yes. White smoke= burning coolant. Blown headgasket=coolant leaking into combustion chamber. Be happy the stealership is refunding you. Maybe get one with less miles on it.

I got it for CDN $20,000; that's with 1 year lubrico warranty (useless). Well I will be taking it back on Monday, and I'll see what happens. I got receipt for oil change, tinting, and full cleaning/buffing so he'll pay me for those too.

Whoever I told this said that this dealer must know he really messed up and that something must be really wrong with the car because he offered not only a full refund, but to pay for my expenses too.

perhaps the dealer didnt know how fucked the car was and would rather give your money back and handle it himself rather than take a spot on his reputation- I know I'd rather not fight in court over a car.

I'll take him on his offer for sure. I'm not sure if he's trying to be "fair", save his reputation, or he knew car was messed up when he sold it to me. It's kinda hard to believe that dealer didn't check the car for accident damage when he got it.

I'm taking it back Monday at noon, so I kinda regret that I won't have time to consult with a lawyer on this one. Maybe this dealer already had something like this in the past so he's afraid he could lose his licence, get in trouble with Minstry of Transportation or who knows who..

As someone who once worked for a very large dealership I'd be willing to bet it was it was a mixture of both. Its the bad side of business - you have a defective product, the choices are simple, lose your money, lose money fix and sell, or try to sell and make money. Any talented dealer would sell you a broken car in the hopes that you do something to relieve the loss of purchase - wreck it, mod it, or even repair it yourself. Right or wrong thats the wisest business choice on his end. By you discovering the root of the problem and filing a claim, he can simply buy back your car and be back to square one. Happens all the time.

If I were in the same boat I'd buy from that dealer again. Most dealers I know wouldn't pay a cent and would fight you until the profit wore out - satistaclly that's the better solution from his point of view. Afterall if he'd buy back his mistake without a fight he is trying to keep some respect.

Just my opinion though...

See I don't know if he's trying ti be fair and save some reputation, or he feels cornered and knows he messed up.

Delivery date was supposed to be Monday, I got the car on Wednesday. Hood latch (sp?), rear suspension (something there), or brakes, were not fixed. In total I took the car back 6 times. Also, I was told oil was changed, when I had it changed after I got the car it was black, and filter so dirty that my mechanic said it was not changed for at least 20,000km.

So he doesn't seem like a fair dealer at all. I'm more than happy to get my money back, but I would still like to know why he agreed to that so fast.

Now I'm not sure if I should still file a complaint with proper orgranizations, after I get the money back.

take the deal dude. so what do u think you would get in return? MORE money? they are already offering to compensate you for EVERYTHING and give you the FULL refund of a depreciated car. If you get a lawyer in this I promise this dealership will drink you for all your money with lawyer's fee's. plus if you get a lawyer you will have to pay him also. i do no believe you deserve anymore than what this dealership is willing to do for you. I think it would be a great pleasure to work with a dealership like that. I think they are bending over backwards to accommadate you. JMO.

You won't do any better than a full refund and reimbursement for your other costs. Damn, what do you want, punitive damages? I thought we Americans were the litigious society. Take the refund, get another car, you're damn lucky to be offered that. Maybe the dealer does this often, and doesn't want word getting around.

My money back first, that's for sure. I was just thinking that hemight try to sell this to someone else, so they'll have to deal with it just like I had to. I don't think these people shold be allowed to sell cars, period.

With all the variables, you don't know enough to make that judgement on the dealer's character. IMHO, I would respect that he offered me a refund and I would have a positive image of him as a result.

Everyone makes mistakes but not everyone fixes them.

I took the car back, with check engine light on, rough idle (CCV issue) and in need of new water pump (loud noise from there). Half an hour later after I had a coffee I got full refund plus all expenses for which I had receipts and I was out of there.

Not too bad at all

It might not be headgasket since its only happeneing when he starts it or under heavy load. More likely hes probably running a little rich. This usually doesn't happen on the newer cars which is what concerns me a lot. However on an older car sometimes you would get the cold start injector was leaking fuel. That sort of thing could be like a leaky injector or something odd ball like that.

Well it worked out ok at the end. I got all my money back plus money that I put into the car (tints, cleaning, maintenance etc).
