Did a Inspection I service at Autobahn,
Fort Worth Texas.
A week later and $600 bucks the car was done. Power stering hoses, valve cover and torx seal. I asked for the rear main seal to be changed while the trans was out. Picked up the car on Tuesday. Drove the car home very quietly. Went out of town for 9 days. Got in the 740i to get some lunch on Saturday. When I put the car in sport the whole trans went south. No park, no reverse, no neutral. Called Autobahn, and demanded loner. Within one minute had X5. Three days later tech called and said car had been rear ended. No joke. I went with my Ducati and a camera to see the damage. Not bad. rear black molding and some lower bumper. Best shop in Fort worth is GTI= 950. State Farm =501. What ever, I am getting car fixed by
GTI. Ther is a Reduction in Value componsation law in texas. What do you think I shoud ask for?

i wish they had that law in New york... its BS to just fix the car, the value will never be the same

Take it to the limit...it is not your fault that the car was rear ended while it was in the hands of autobahn. What were they doing with the car when it was rear ended.

when and how was it hit? Was it hit at 1:30am when the tech and his girl were leaving the club or what. Screw that my friend lost his entire 200k a year business because one of his techs took a customers car home one night and wrecked it drunk into a tree and got a dwi from in the emergency room. The business was PFS. Peter Ferrell had the top RX-7 performance shop in the world and lost it all in one night. 1 million dollar law suit later and he is out of business forever as per the "settlement out of court".
I would find out more info on what actually happened to your car because I have a feeling you are being lied to. Cars don't get rear ended in the parking lot waiting to get repaired. And if it was just a little fender bender out side test driving it then there would be a police report on what time it happened. If you do not have a police report call the cops right away because you could have been used in a hit and run or numerous other illegal things. I would be on the phone with the cops and my lawyer right now.

Negotiate your own settlement.
Since the rear end is somewhat messed, have them throw in a SS exhaust, complete with ACS (or other) custom rear valance, and call it good...just a thought.

I do agree with him.....if there is no police report there is a problem somewhere and from his experience, you may want to investigate. Many times we look at the present and see dollar signs, but not looking towards the future could really cost you, or could prevent you from getting what you really deserve out of this.....
Sounds like they are handling this a little too quickly....

You shouldn't even be considering paying for the bodywork yourself. I know some shops- primarily bodyshops post disclaimers about being responsible for items left in the car because most places keep the cars outside in the parking lot during business hours and they don't want to have to lock every single car in the lot. I lost a radar detector out of my RX-7 this way and as pissed as I and the shop owner were about it, I was relieved they went for that instead of the stand alone ECU or my $300 head unit.
However, damage to the car that is inflicted while it is in the shop's care is inexcusable. It simply means that somebody was doing something they weren't supposed to- either fooling around or not being careful when they parked it in one night or were moving it around and backed up on something or were bumped into.... Ricky-stylin it around town like the fool from PFS. Check the mileage on the car and make sure it doesn't add up to a conclusion that it had been driven off the lot after you dropped it off. Normally, you'd definitely want to go to the police because anything involving insurance should have the police report on it so that your provider understands that it wasn't you who dinged up your car. On the other hand, you shouldn't be paying for this at all, so it'd be best to leave it out of insurance's potential harm to your rates. I would definitely have the shop pick one of a very few options to settle with you on and the minimum would be to cover complete cost of top quality body work for your car.... I'd even make them take care of everything and pick it up from them at their shop after its done... meaning they fix the trans and certify their mechanical work for real this time around, then flat bed (not drive) the car over to the body shop of your choice, have it done right, and call you when the car is back at their location, or have them deliver it to your home to make up for the inconvenience of having you make the trips back to the shop more than necessary.

Well I took a lot of you guys advice. Dropped the X5 off to day and asked for the police report. No such thing. I did
receive a check from the appraisers damage estimate and my body shop, that only fixes Porsches said it was a good estimate. I pick up the car tomorrow.
About the Reduction in Value Compensation......Autobahn said they will give me a letter from their used car guy about the differance between a 740i with a golden carfax and one with a ding. KBB is about $1500 down from excelent to good. But BMW dealer retail is a bigger differance.
Any of you lawyer guys think that this is the dealer or the lady that hit the tech test driving?
