View Full Version : BMW of Fremont: Redefining the word stealership..

I had my car towed to BMW of Fremont last weekend, becuase of a tire blowout. My normal service adviser Kenny Lampton wasn't there (who might I add is an excellent stand up guy), so Mike Schnur handled my case.

So, my car was towed to BMW of Fremont, my buddy needed a few things out of my car, so the next morning I drove there to get his stuff. I grabbed all of his stuff, and also I noticed my camera sitting in the back. I figured that a tire swap would be quick and you know I trusted them, so I thought nothing of it at the time.

Well, I go to pick up my car and I drive out and look in my backseat and my camera is gone. I head immediatly back to the dealer and talk to Mike, he says no one even entered my car. Which was a blatant lie since the seats were pushed back and also there were tags inside the car. I called him out and his only answer was I don't know. Aside from that he was being an extreme anal-chasm about everything.

While I know it was stupid of me to leave my stuff in the car, I trusted the dealership and did not think they would stoop to the level of theft. Mind you I forgot to mention, this particular camera goes for roughly $2,000.

So, I'm warning you guys about Mike - he's a comepletely unprofessional. I doubt I will be getting my camera back, but all I can do is hope.

Threaten to take them to small claims court do you have a receipt and proff you left it in the car. If your friend was with you use him too they are responsible for anything taken in the car too. Also tell them you will report them to the BBB Better Buisness Bureau. Hope it works out.

When I go the dealer and leave my car there, unattended, I always take all my valuable stuff out. I trust no one, unless I am sitting right there. The service advisor to my best experiance doesn't even leave the office to look at the car so he doesn't know what the hell goes on at the shop. In part it was your fault, but it was also theirs, be careful of what you signed and chekc to make sure that they are not responsible for lost or stolen items, and then you can sue them in small claims. Good Luck though, most likely it was one of the lower end workers because I doubt a master tech would bother with a tire change.

you'll see it around somewhereThe dealership can make any policy they want, it doesn't mean it holds any value in court. Many places claim they are not responsible for lost or stolen items even when they legally are. If he didn't sign anything stating otherwise, then the dealership should be held accountable.

Even though someone at the dealer probably jacked it, I think you can't do anything about it. Dealer has policy about not responsible for missing items when servicing your car. Plus for a 2k camera, I wouldn't have left it there just like that.

thats not necessarily true, master techs don't mind doing tires because its easy money. I would point the finger at a porter, half of who are usually high at work anyways.

The fault is half and half. About a week ago my buddy found a hair in his fries at In-N-Out. I stumbled up to the register and told them I'd report it to the BBB, so they gave me a huge batch of fries within 20 seconds... hopefully without more hairs. Point being, businesses are scared to death of the BBB if they have any credibility. Use that, and maybe talk to Kenny about the dickhead. Just don't wait on it. Then they'll say you should've told them about it earlier. Good luck.

all i can say fremont bmw went down hill after they went solo. when they were clairges bmw.. they were alot more perfessional. now.. blah..:confused

Business aren't really scared of the BBB, as long as they are doing things by the book...

For future reference, if you go a restaurant and there is a problem, and the FIRST thing you try do is start crying, "Oh, I'm going to report you to the BBB" your response isn't always going to be favorable...

...Especialy if your dealing with Sicilians. :shifty

In my book, courtesy and class go a LONG way. If a customer has a complaint, I will do EVERYTHING in my power to make the situation right. However, if a customer approaches me with threats (or foul language, insults, etc.) I will politely show them the way to the door, and make it clear to them that if they ever make the mistake of showing their face in the area again, they might run into some serious problems.

That being said, I agree, don't sit on this situation. The longer you wait, the less credibility you will have. Talk to everyone in a position of authority there, and if that doesn't work, take outside action.

not always mexicans, we've got a group of recovering alcoholics and drug addicts as porters now (probably about 6 of them from this program), and an audi dealer near here has retarted people as porters (but aren't allowed to drive the cars).


I used to slam dealers all the time, but I have had the chance to work for both an independent shop and a dealership, and trust me... the dealer is MUCH more honest and trustworthy. I will never work independent again.

It doesn't matter what their policy is. That's just like having someone sign a legal release if they're going to jump off the roof of your house so they can't sue you. In that case you showed negligence by knowingly letting someone do something like that on your property. That's just the way the law works. You could have a notorized document with his signature on it saying he can't sue you no matter what, blah blah blah... but you're still responsible.

Anyway, if the dealer showed negligence in this case, it doesn't matter what their policy is; they would still be held accountable. The only problem is, you won't be able to prove anything in court. Sorry. I used to work in a body shop and there were some pretty shady guys in that industry who I wouldn't have trusted within 10 feet of my ashtray full of change. I definitely wouldn't leave a $2k camera in plain view. Good luck getting it back though.

I guess it's different when a guy stumbles up to the counter and they can smell a large amount of (don't really remember how much) alcohol on his breath. Maybe they were trying to avoid problems with 5 drunk guys right after midnight (don't remember the exact time either). :D

Come to think about it though, BBB has more influence over restaurants, because people don't really care how dealerships are rated. It's not like you digest stuff at a dealership. Still, raise a fit!

If nothing else, spread this story on every BMW and European car forum you can think of, and then e mail all of the links to the said offenders.

It won't really accomplish anything for you, and they might not loose any business over it, but at least it might make you feel better?

You never know what happens when you drop off your car at dealers.
Once I dropped off my Lexus IS3 at dealer for some warranty work to replace the radio unit, they put on nice 20 miles and i found some french fries and napkins in my car. I mean you guys are changing the freaking radio, what's the 20 miles for??
But I've had good experience with MB dealers so far.

1) Do E46's not have a spare? I believe they have run flats or something comprable. Correct me if I am wrong.

2) While it is certainly a sad fact of life, you should have been more careful with your camera. Given its value, I would think you would be more careful with it. Did you not think someone would be tempted to steal it?

I have worked with Mike and I disagree with what you are saying. He is a great guy! I have worked at dealerships and they get blamed for a of things that they do not do. Have you ever considered the tow truck driver who towed in your vehicle? NOPE! Those guys do steal things. The camera probably was not even in your car as well. Were the tires ever replaced? Maybe your buddy stole your camera! Sounds like the dealer did not stoop to your level of stupidity......

Get a life and get over it!

I hada PROBLEM with them ALSO. I took my car for service....its done...go to pickitup....my BWM floormats in the FRONT are BOTH gone. I ask...they say..."there wasnt anything there when it was bought in"......why WOULD i have two back floormats but no FRONT ones? They stole my floormats but i dropped it since it wasnt a "major" pricey item. Anyway, BMW of Fremont OR WHATEVER THEY GO BY SUCKS!
