View Full Version : i hate cops... anybody know a good lawyer?
puntr26 01-06-2006, 03:23 AM so my friends and I are coming back from glory days in c'ville, and my friend and I are driving home (he's in his 92 vette with his gf, im in my car with my gf and a friend). we get to a stop light with no cars and about a 3 mile straight away (2 lane). The light turns green and we both floor it. He starts to pull on me :( so I let off the gas around 80, he continues on and hits about 110. I see a VW coming up fast and blow by me followed by an undercover cop doing about 90. At this point I'm saying damn... brent's screwed (in the vette). The cop stops in the middle of rt29 with all his lights on and points all of us on to our turn.
For a second I thought to myself I could pull a u-turn and get away... that is until i see a second cop flying up behind me :help . We all turn and to make a long story short he does NOT clock our speed with radar, or by pacing. He gives my friend and I a ticket for "Reckless Driving" and "Racing on Highway"
He said it's a class 1 misdomener (sp?) and its a penalty of up to 1 year in jail, a $2,500 fine, and my car getting siezed :help :help :help
ANYBODY know of a way i can fight this, or have a good lawyer?
ps, I NEVER street race (with the exception of tonight) or speed a lot. this really sucks and i can't afford to have this on my record :(

If he didn't clock your speed or pace you, how can he give you a ticket for racing? It's his word against your word. But wait, this is Fairfax County, so the judge automatically assumes the cop is always right. A cop can get away with murder in this county, and he wouldn't be charged with anything.
puntr26 01-06-2006, 03:44 AM we started on 29 & stone road heading west and he pulled us over on 29 & plesant valley rd. The cop told me he was a few cars back and he saw/heard me squeel my tires. I'm sure I'd have a chance fighting this with a good lawyer and some research

You dont have to be given a ticket for speeding with racing. The way the law is written, you could be caught for racing from 0-45MPH right?
Anyways... the law also kind of words it so that racing must have a defined start and finish. They've got you on the start part (traffic light), but was there some definition of a "finish"? That's about the only technicality you can get away on... and the judge probably wouldnt buy it unless you had a pretty savvy lawyer.

Honestly it sounds like you screwed yourself. You were racing, the cop saw you were racing, and you got a ticket for racing. Bummer.

jasonknezo 01-06-2006, 11:43 AM the way racing on highways law is worded in pa is that "any act of a speed challenge or display of speed with another car" and reckless is anything dumb in an automobile-ive beaten 3 racing tickets 155 mph speeding ticket etc etc, was very wild when i was younger, get a GOOD lawyer, you will need it and expect it to be over 2 grand if your paying. I got lucky and my uncle was a supreme court lawyer at the time but i wish u all the best luck man, everyone deserves a second chance and trust me it sticks in your mind afterwards.

How on earth are the cops gonna prove you were "racing"? They were apparently pretty far behind the action, and the "race cars" were pretty far apart. One "race car" let off, while the other continued on, and then another "race car" came up from behind and passed the "race car" that had let off . . .
See how stupid that sounds . . .
Sounds like some cops saw some fast cars moving at a fast clip and wanted to ticket you guys for SOMETHING, but knew they could not prove anything in terms of actual speed, so they claimed they witnessed you street-racing.
Judging from your post, I suspect you likely incriminated yourself via your mouth.
I hope you did not tell the cops that you knew and/or had communicated with any of the other drivers, etc. Or that this was your first street race . . . or you just wanted to see who could pull on who, etc . . .
If so, get ready for the pokey. :ky

He has the right to bitch if the law is written in such a way that any sort of accelerated driving can be considered as racing. Just because something is the law doesn't make it right.

He may have a defense and I hope he's learned his lesson and gets off, but he admitted that he was racing!

The dude admitted they were racing, the cop obviously was around and caught UP to them while they were racing. I agree he should get a lawyer and try to get out of it, but don't give a sob story about civil liberties. They were f*cking racing.

I def know that racing isnt worth it... a lawyer and court costs are going to be a couple thousand dollars.... just for 10 seconds of racing

You definitely need a very good lawyer. I wouldn't make assumptions about how you might get off. Was this a State cop or Fairfax County? Virginia is coming down hard on speeding and isn't cutting folks any slack. A racing charge is nothing to fool with.
