My new car... bastard fu(king hit it!
I was at Kahala Mall and some guy came out of his parking stall and hit my car.
God damn I'm pissed.
This guy not only doesn't apologize, he starts laughing and sh!t.
I wanted to smack that smirk off his face.
I just got the car back from the body shop for that dog incident a few days ago too...
My driver's side rear wheel is curbed.
My driver's side door has paint scratched.
My driver's side quarter panel is dented in.
My driver's side rear quarter panel trim is dented.
We exchanged information and I called my insurance company.
Is anyone familiar with things like this?
I've never been involved in an accident before with someone else.
Will the insurance company contact me later?
Do I have to pay for his stupid mistake?
The officer said that if he doesn't pay my deductible, then I have to take him to small claims court because it clearly wasn't my fault.

Im so sorry about what happened especially since its new and its a M! damn those kinda people!!! Don't worry just contact your insurance company and he'll pay! Im pretty sure his insurance will cover all of the damages. man i feel ur pain i hope that guy gets what he deserves!

let me guess, was it a toyota? IME most dumbasses who can't drive/don't pay attention are toyota drivers.

As for the guy laughing, just brush it off as shit happens. The guy is gonna feel it when his insurance premiums go up.

A somewhat similar situation happened to us twice, where the damage is potentially less than the deductible. Your damage may exceed your deductible and so that may change the whole situation. In any event, we did the following:
We contacted our insurance agent to let them know what happened
Because our damage was potentially below the deductible, the insurance company doesn't necessarily get involved because they have no financial interest in the incident. If the damage is greater than the deductible, then the insurance company will step in and arrange for the damage to be repaired less your deductible. They will then chase his insurance company for the amount that they are out (and potentially your deductible). Otherwise, if the damage is less than the deductible, you may have to chase him personally as the officer stated. HOWEVER, my insurance company did suggest that I call the person back to let them know that I contacted my insurance company and that he should contact his to inform them accordingly. This is in an attempt to make the case sound "official and serious".....If it sounds serious, the person is more apt to call his insurance agency to follow-through.
Once the guy contacts his insurance agency, his insurance agency will normally follow-up and contact you to arrange for an adjuster to inspect the damage.
Once inspected, they'll either cut you a check or arrange with you for repair of the damage.
The key in OUR situation was to have the person call his agency to arrange to have the damage taken care of.
Again, this was our situation. Circumstances may be a little different for your situation...

Bummer about the hit, and as JP says, call asap to be sure everything is accurate. Hopefull he wasn't in a stollen car!

It took a lot out of me not to go AWOL on this guy.
From my guess... the damage is about $2500 and about another 2 weeks at the shop...
I was wondering if there is any place in Hawaii that does wheel curb repairs, since most likely... the body shop will not cover that.
THANK YOU GOD that this didn't happen with my HREs on.
Jeez... this car is seeing more time in the shop than on the road :(

The cop said that his presence was only to help exchange information.
I took some pictures at the scene of the accident and even the cop says it looks pretty clear cut that it's not my fault.
I'm gonna contact him tomorrow to see if he has contacted his insurance company yet and I will contact my insurance company again tomorrow.
BTW... it was a Ford Escort.
And by the looks of it, he didn't seem to care since it was already kinda messed up before it even came in contact with my car.

and sometimes they laugh because they are on drugs. 9 years ago some bit¢h rear ended an acquaintance of mine stopped at a red light. victim was on a bike, luckily he wasn't hurt, bit¢h laughed hysterically, she was on drugs.
gmh - JP is right, you have to call the insurance co. the best thing the other guy can hope for is that you sit around and do nothing.
judging by the other guy's character, he is in no rush to inform his insurance co. it's not necessary to give him the "courtesy" of informing him that you're calling your insurance. sounds brutal, but i say fu¢k him, i've been at the receiving end enough times to know when the perpetrator truly feels bad or is just being a di¢k.
once you call your insurance, they'll ask you for the other guy's info from the police report, or they may try to get it directly from hpd using the report # you give them. they'll follow through by getting after the other guy's company (that's part of what you pay them for). the other company will try to determine fault, then the adjuster will contact you or you may be referred directly to one of their "approved" repair shops for an estimate.
The Beastmaster 10-11-2005, 03:48 AM Request a new rim or money for a new rim. Then send it to Tod Ruston at Alloy Wheel Repair. He should be able to do it for $85 - $100. Realoem has 1 wheel @ $555, so at BMW it'll be @ $700+.

If the damage is in the $2,500 range, then I'm sure that it is beyond your deductible and your insurance company will most definitely get involved. No need to call him to follow-up. Just have the insurance company work for you. In my case, it was/is below the deductible so I am sort of paddling alone up stream. Fortunately, the guy admitted fault and his insurance is following up..

I had to call his insurance company, and no surprise, he didn't even contact his insurance company...
Anyway, yea.. I'm going to try have the damages covered under his insurance and he pays the deductible.
I mean... already I'll be without my car again for like 2-3 weeks and my car's resale value has gone done because of this stupid incident... I shouldn't be responsible for my premium going up and stuff too...
Hopefully... this thing doesn't hit any major complications. I have enough of that already.

The insurance company says that they can't give me any money and I can't authorize the body shop to fix my damages yet until they get a statement from this guy.
The insurance has called over 5 times over the past 3 days and he has not called them back.
I spoke to him once on the phone, and he said that he'd call them, but still hasn't.
He may be holding out for some reason.
Anybody happen to know why he's holding out?
Is it possible for this guy never to respond and I'll never get my fix-it money?
Has anyone ever been in this situation and know what to do?
I know his insurance ends sometime in November.
However, the accident happened in October so does this mean I'll still be covered or the insurance company won't pay me once it expires?

I took my car to Central Body and Paint in Aiea next to the Ford dealership.
The BMW dealership here takes all their cars for repair there so Central is like "the" BMW body shop here in Oahu.
Try asking the MB dealership where they take their repairs to.
Usually... wherever the dealer takes it to... the shop will be the most familiar with the car and will match the paint the best.

You can always threaten with a lawyer...which sometimes works. Best is probably to claim it on your own insurance and have them pursue the guy and his insurance company. Your rates should not be affected. Also since the policy is in force when you made the claim you have nothing to worry about if it lapses.
Tell the guy if he doesn't make the call, you'll just turn it over to the insurance company, and THEY WILL pursue him.
