View Full Version : NY Speeding tickets
paul e 04-10-2005, 02:04 AM Anybody here familiar with NY speeding tickets? I got a ticket Oct, 04, to which I pleaded Not Guilty to, and sent it in... How long should it take to hear from the court on a hearing date? Its been almost 6 mos and still I ve heard nothing. I guess I should consider myself lucky, but, is there a statute of limitations on how long they can notify before the ticket is null and void? During this period, I presume the ticket is not on my license, and is therefore not figured in to the 18 mo. periof for assessing speeding tickets for the purpose of mandatory license revocation. I got another one tonight, to which I also pleaded not guilty, and am not beginning to worry if another one in 18 mos means mandatory revocation.
Anybody know any good traffic attourneys in Westchester?
G.J. Dixon 04-10-2005, 06:57 AM What Police Departments issued the tickets? Depending on if its Town, County or State, it makes a difference. I would think that you should have received a summons by now for any of those, but sometimes County or State can take longer.
Usually when you plead not guilty on a speeding ticket, when you have your court appearance, normally you meet with the issuing officer before you go in and see the judge where you will plead your case to the officer and he'll usually drop the speeding charge to a lesser offense when in front of the Judge, as long as you hadn't given the officer any attitude, or have any/many prior offenses he'll go easier on you with helping you to get a lesser offense.

Thank you for replying.. My tickets were both issued through the White Plains Court. The issuing officer told me to plead not guilty, and they knock some points down at court... If that really meant theyd change it from speeding to another violation, that would be great, but I just got teh feeling it meant they might claim like 10 mph over the limit, instead of the 21-30mph category I fell into. I replied to another site, and a lawyer in Portchester just contacted me by email, to find out what teh problem is. Ill persue with him, and depending on that outcome, i may give your referral a call, for which I thank you. You know, the october ticket was really kind of bs.. It was issued in an area of white plains where they were doing some construction on the lanes, near North Street area... I found myself in a lane that was ending, and the only real way I saw to extricate myself was to briefly speed up from about 35 to 50 or 55 to ease myself into the traffic just head of me, and then slow back down again. Which I did.. But , he flagged me during that burst.. It just happened to be a trap area, as they apparently sit there all day flagging people. Im going to fight that one.. Prior to that infraction, my license was completely clean, and Im a responsible citizen in my 50s. What really scares me now is that last night's ticket makes two, if they both wind up getting convicted. And we all know that one more means license revocation mandatory. And here I am with my beautiful M3, over 400 hp at the engine, and if I want to exercize it, I guess Ill have to visit my friends in ct! Well, hopefully I can find a way to knock these down, or off.. Or maybe, the oct ticket may lapse before they call me for court, if such a thing can happen.

Dixon 04-10-2005, 07:47 PM In most cases when the driver has a clean license like you did up to that point, they will respect that and change the violation to a non moving violation which will reduce your points, then you will still have to pay what ever the fine is that they give you. Depending on what the severity of your violation was, depends on what they can/could change it to. Not many people know this, but sometime around September or October last year I believe, the Speeding law changed and became much more strict. Anyone receiving a ticket at 20mph+ over the posted speed limit now looses their license automatically for 6 months or more. 20 mph over the speed limit is now considered wreckless driving, wreckless endangerment.

What?!! You absolutely sure about that? HOw come theres no info online about it? Since 20mph over the limit is not an unusual occurence, youre practically saying that everybody who gets a speeding ticket in NYS loses their license, whether its the first, or the third occurence. If this is true, i might as well rip up my license right now. And, since were talking bmws here, so might as well every other bf member who lives in nYS.

not exactly... now they make you pay a heavy surcharge, for having 6points (equivalent to 20 over limit) check this out: http://www.nydmv.state.ny.us/drp.htm

read the links in my post b/c this applies to you... you should hire a lawyer asap and contest both tickets... they usually charge a flat fee and it's worth it...

Im totally screwed.. I have one 53mph in a 30 mph zone in Oct, and one 55 in a 30 mph zone yesterday. AT face value, each is a 6 pt ticket. Youre allowed 11 pts in 18 mos.. Apparently, when they call these to court, Ill have 12 pts on my licence, and, being over the limit, I dont even have to wait for the third speeding ticket, for this alone puts me over.
In addition, I have an illegal left turn, which I didnt see any sign for, whihc is worth 3 pts...
My only hope is, they knock the speedings down to a PLUS 1-10, worth 3 pts each.. Ill then have 6 pts for speeding, but at leaset, Ill be under the 11 causing the revocation... The officers indicated this is what theyd do, when they gave me the tickets, so I guess this is teh best i can hope for.. IF they dont knock it down, Im going to be one unhappy camper.
sardil 04-10-2005, 11:31 PM Get a lawyer asap. Their $500 fee is worth the weight in gold. Make sure you get one local to the jurisdiction you were pulled over in. Thats the biggest factor in choosing one.

ct323i 04-10-2005, 11:32 PM you should invest in a Valentine1. that would prevent tickets in the first place. I always go double the speedlimit or more and haven't gotten one speeding ticket yet.

just hire a lawyer and contest them... no ifs or buts or representing yourself... most of these juristinctions just do it for the money... if the lawyer is any good you will walk away with a very expensive parking ticket...

Hes off at a slight angle as I approach.. Bam.. he hits me with his radar, and gets a reading.... The next second, my V1 goes off.. Guess what.. ITS TOO LATE.. What am i going to do... Say, 'Whoops, I better slow down quick?'... hes already got me!! .. Dont forget who fires the first strike here.. V1s work when there is radar In the Area, and you can pick up a trap before you enter it.. But, when youre the only one around, tell me how a detector will help you when his first strike has already picked you up, before there is anything to detect? As for going double the limit, count your lucky stars, because you WILL get caught... And when you do, at those speeds, its jail time and mandatory license revocation. Dont be so smug.. I went years; decades, without any tickets. Then, in the last 6 mos, Ive had 2 speeding. Your number will come up.. it always does.

Just hired one. My research has found that generally, they are charging between $500 and $800 per violation.. IN my case, I have 3 violations (2 speeding, and one disobeyed traffic device) So I worked out a pkg deal at $1000 for all 3. Damn this stuff is expensive. If it were just one ticket Id do it myself.. But in this case, face value is 6 pts for each speeding, and 3 pts for the traffic device = 15 points = mandatory suspension!!!! Because of that I just bit the bullet, and hired the lawyer.. Im not screwing around with losing my license, no matter how much it costs.
sirtiger 04-11-2005, 06:11 PM V1 helps, trust me. yes, its not 100%.... but if he is gunning other cars in front of you, u can pick it up if u r behind it b4 its too late...of course if u r smacking 150 mph while everyone is going 55, then u r asking for it.

Thats what I said. I also said that in my case, it was at night, and noone was around, but me.. Zap, and he had me.. It wasnt 'in the area'.. it was aimed at me. And he got me.. . Both of my tickets were like this. V1 would have done nothing for me.
BTW, I do have a detector.. Its not a V1, but it generally picks up laser, and the main bands.. It doesnt have POP.. In this case, teh cop said he used Pop type, AND laser.. But im suspicious that my laser detector didnt say boo, and its usually pretty good with laser.

Incorrect. Radar is constantly on (unless its one of the few Instant On ones out there). You would have picked up that radar signal long while ago with a V1, regardless of if there was anothing car in front of you, or even without a clean line of sight.
In any case, lets not turn this into a V1 thread. Good to hear you got a lawyer, the pricing sounds right. You got all three tickets in the same jurisdiction?
paul e 04-11-2005, 07:03 PM Well, heres a small update... I heard from the court.. Theyve scheduled my first speeding ticket hearing, of the three infractions Ive pleaded Not Guilty to, for June 13. This is the one where I was in a left hand lane in a local construction area, and I saw the lane ending up ahead, and with cars on my ass, rather than jamming on the brakes, I sped up a little, so that I could fit into the flow of traffic up ahead, before the lane ended.. This slight of hand managed to get me a 53 in a 30 mph zone or something like that.. Full points would be worth 6 on this one. The lawyer will have to tell me whether I should attend or not; usually he just goes in the clients place.. Cop told me at the time hed reduce it at the hearing. So I need lawyer to tell me if I need to be there, to remind him of that little fact. All I need is it dropped from a 6 pt deal to a 4, on both this speeding and the other, and I should be ok. Interestingly, theyre calling them out of order.. I had a 'disobey traffic device' ticket handed out about 3 wks before I got this speeding, and i havent been called on that on yet... If I get suspended, Im really up the creek.. How mi supposed to buy groceries and supplies.. Hmmm. I wonder if grocery stores deliver around here.. LOL.. Never had to do THAT before. Bah... this couldnt happen; its unthinkable.. Sheez..
