Anyone here in GA region an Attorney? I don't really care what law you practice. I just want some help. I mainly need a canned response letter wrote up and sent to my parking garage insurance company. My car was broken into and all of my stereo crap was stolen 2 months ago. I was told I would get something but I was denied. Since the break in, the parking garage now hired a full time security guard that walks around all of the levels. I received a canned denied letter saying they weren't responsible and there was nothing Interpark could of done to prevent this.

There were 5 break-ins that day including a stolen vehicle and now they conveniently hired a guard 2 days after the break in, after seven years of parking there, even though they said there is nothing they could of done. Why hire a guard then?

I will give you 10% of whatever I get. I am either hoping to get my $500 deductible back or $2000+ from the stolen items.

I just feel like I will get a better response if a letter is sent from an attorney vs me. This will literally take just 20 mins of your time to type.

Nothing sadder than a thug all tied up in paperwork.

Almost every parking facility I've even seen has signs saying that they are not reponsible for articles in the car or damages to the car. Otherwise they would just always be getting hammered with "somebody stole my stuff" or "someone hit and run" my car.

Good luck, I'm always down to see the man get screwed, but I think basically, it's just an insurance claim and you are hosed.

Not saying that it is exactly the case here, but alot of the time just because a sign is there and says this or that does not make it legally binding.

The parking garage manager said it was different since it was an act of vandalism. They had 4 vehicles get broken into and one get stolen. Whats the point on paying $70 a mnth to park and have 0 security? They got video cameras at all the corners one one of them wasn't pointing in my direction. And like I said earlier, why hire a security guard to patrol the garage now from 8-5pm? I've been there 7 yrs and they just now hired him 2 days after the thefts. If they feel like its not their fault, why waste money paying a flunky to patrol? To me they are responsible when a group of people can walk around and break into so many cars within a 3 hr window. I pay $70 there should be some form of security.

I agree, but, it basically sets it up so that of you don't agree with the sign, then do not park there. Of course, there will be no better place to park, so, it's a catch-22.

Say I'm at someplace like the Mall, and someone opens their Denali XLT MegaCab 3000 WifeBeater Special Edition door into my poor hapless Batmite. The dimmest of lightbulbs goes off in my head and I rush to my local parking deck and claim that it happened there.

I just tried to fight the parking deck at the Congress Center. A little different though, I was claiming that they were negligent for not opening a pole that kinda blocks the entrance. I went and took pictures of how the pole is ALWAYS open during business hours, but it was not the particular morning that I hit it.

My insurance company was not interested in fighting this for me, and they basically said, don't hit poles. :mad

Thanks man. Just give her a break down of what happened. Car got broken into along with 4 other vehicles and one got stolen all within 3 hrs. I was told they were suppose to compensate me. I got the canned denial of claim letter. They don't know that I know about the 4 break in from that same day and the stolen car. It is a monthly paid covered parking lot with an attendant at the gate and the manager in a glass building in the garage. 2 days after the break-in after seven years of me parking there they now hired a security guard that walks all the levels. The canned letter said "The parking company could have done nothing to prevent this." WHy hire the guard then?

Are you sure it wasn't an inside job? It seems like the group/person knew where to dodge the cameras or knew how to dispose of any film that may incriminate them/him.

I am starting to think the same thing, but they also stole a 4-runner. I assume they used the 4-runner to toss all of my crap in there along with the other peoples junk. If there wasn't a stolen vehicle involved, I would think it was an inside job.

I’m not a lawyer… But I did stay at a Holiday Inn Express! :)

Seriously, I’m digging deep: As a business they owe you (and I suppose this could apply to your property) an extraordinary level of care -– especially factoring in the prior thefts. This still applies even though they probably had a disclaimer on the parking ticket and printed elsewhere. I would search the internet I’m sure there are templates available for free or very cheap. Im sure if you fight this you’ll succeed.

I am an attorney, so here is my quick legal disclaimer...what I am about to type is not meant to be legal advice and should not be construed as such.

That being said, it is legally irrelevant that they hired a guard or guards afterwards. Any evidence of remedial measures taken after a crime/accident are inadmissible in court, therefore if you mention such remedial measures in a letter, it will likely have no effect.

Someone mentioned that the dislaimers on the signs/parking garage tickets usually aren't enforceable and that is somewhat true, but you typically have to prove that the parking company was negligent in some way. In this case, unless they somehow led you to believe that they provide security, I think a fact finder would conclude that you assumed the risk.

So, in conslusion, having been down this path once before in my life, I would recommend paying your deductible and moving on. Sometimes it really isn't worth getting into the mud and getting dirty with these types of companies.

I already paid my deductible. This happened 2 months ago. I was trying to get compensated for something only because the parking manager said I would. I did not park here for one day and leave. This is a monthly parking garage that I have been parking since 1998. I use a swipe badge to get in.

I asked my wife about it and she said that she couldn't help b/c she's not a lawyer yet and it would be unethical.

Off the record though, she told me about the same thing that M3Bill said and that it probably wouldn't make a difference if you had a letter or not and that it's really not worth the fight. She also said that if you get a lawyer to work on it the going rate for this type of thing is about 33 1/3% of the recovered sum (except in medical malpractice, 40%) so you have to take that into account if you end up hiring someone to help with the $2000+ (2000* 33.333% = $666 > $500)
