BSR423 06-22-2004, 08:13 PM I got pulled over about 2 months ago driving on 301 on the eastern shore. It was me & a friend/BMW driver following to meet up with another friend that was house sitting for his brother. He said to meet him at the outlets right at the 301/50 split. Well...I didnt see the outlets & went about 10 miles up 301. I call my friend & tell him how far I had gone. He says "You went to far $#!% head" so I'm all :mad: & had to piss so I pulled into the next rest area. I'm on my way back , still have my friend following me , we get to a break in traffic. There was about 1/2 mile between me & the next car on the highway. I decide to lay into it. Looking down at my speedo & I was at about 115mph. At that point I decided to slow down & wait up for my friend. Look in my rearview & what do I see. :pullover A land shark FLYING up on my ass. I'm thinking to myself "This one isnt going to pass me ! !" so I hit my turn signal before he got very close. I had my license & registration in hand , so I started to flip through radio stations. Found a country song that is pretty relaxing , so I let it on. Cop walks up to my car.
cop: you were going pretty fast back there. "In a shockingly calm voice!! I seriously think it had something to do with the country music. If I would have been playing some G-unit I'm sure this story would end differently."
me: sorry about that!! *hands license & registration out the window.
cop: you have any idea how fast you were going when I clocked you?
me: I really couldnt answer that ossifer.
cop: If you can guess to the T how fast I got you going I will give you a HUGE break.
me:hmmmm 108 - 110? 0_o
cop: hahahha! 107.
Cop starts to walk back to his car & another state boy starts to pull across the median. I really thought they might be locking me up so I get on the cell & call my friends that passed me. The 2nd walks around my car. I know he's going to say something about the front plate.
2'nd cop: Where is your front plate?
me: Right here under my floor matt ossifer.
2'nd cop: OK. *walks back to 1'st cop.
1'st cop comes walking back up to my car. This is about 15 minutes in.
1'st cop: Your pretty honest. Most people would have said something like 80 - 85. A lot of the time when we "as in cops" see people going that fast they run & we dont catch them.
Hands me the ticket & starts to explane that I can either pay the fine , or take it to court. I look at the ticket. NEGLIGENT DRIVING :buttrock with a $255.00 fine :( . Look at the 2'nd ticket. No front plate. $55.00 fine.
1'st cop:Slow it down buddy.

I really think the music that I was listening to ATM had something to do with his attitude towards the situation ! ! I still havent got a court notice in the mail , but I'm sure I will. I need to know if the judge can issue a worse charge for this. There is nothing about how fast I was going on the ticket , but can the cop say something like "I was trying to go easy on this guy with negligence , but since he wants to see me in court over this I want him to learn his lesson." I plan on asking the judge not to issue the point for negligence , but charge me the fines. I KNOW god blessed me that afternoon & I am asking a lot by standing in front of the cop that was so easy on me but, I DONT need ANOTHER point.
Lactomaniac 06-22-2004, 08:53 PM is there points involved with negligent driving? if there isnt any points involved go ahead and pay the fine. if there is points involved, take it to court and hope they will reduce the points or perhaps pbj.

take it to court...you're ALWAYS better off...
believe me, i'm an EXPERT at traffic court (unfortunately)...
usually for a five point ticket if you go to court it'll get knocked down to 1 or
2 points and court costs. if you have a clean record, you might even get PBJ
(no points).
one time, i went to court for one of my 5 pointers and the judge asked me
about my driving record...i told her it was HORRIBLE and gave her a short
apologetic speech...she SOLD me PBJ for $275...worth it if you ask me!
BSR423 06-22-2004, 09:48 PM WHOA ! ! 5 POINTS ? ? ? :eek: I was told by the cop that issued the ticket that I would be facing 1 point. That a negligent driving ticket is issued for running a stop sign/squealing tires. Minor traffic violations.

at work told me it was 5 points...i believe him...but i should be going to court

BSR423 06-22-2004, 10:11 PM I didnt see negligent driving in that list. Hopefully I will get: "(1) Any moving violation not listed below and not contributing to an accident 1 point"
One point doesnt sound so bad after the thought of facing 5.

rainy morning 695 traffic...
got to the designated work parking area...did slalom under parking garage to
my spot, buddy came up in his jeep, did a few donuts...trooper was under
the parking garage...never saw him...he came up and wasn't trying to
conversate about it at all...he gave us both the same ticket...i really just
could not stop laughing at the whole thing for about 2 weeks...that was in
november...just got the court paper a month ago...
Lactomaniac 06-22-2004, 10:27 PM when i got my 5 point ticket, i got a lawyer and ended up with 1 point. i have to goto "positive alternatives to destructive driving", but this is howard county so they are especially keen with their traffic ticket assraping. i had a clean record and my lawyer did the whole "he's a good boy" routine. still, if i get another ticket, i'll have 5 points automatically, plus. i still got off really well though.

Insurance companies really dont like that on your record. Negligent Driving and Reckless Driving are both very serious offenses.
The difference between the two? Reckless is worded as something like a "willfull and wanton disregard for others saftey"
Negligent is something like "having the intent for disregard for others saftey"
Definitely goto court.

BSR423 09-03-2004, 06:20 PM Things went pretty well today. I got to the court house 20 minutes early. The door to the court room was locked so I had to wait. Gave me a little more time to think. The bailiff unlocks the door & tells everyone to come in & have a seat. As I walk past him I took my cell phone out & turned it off. I'm sure he was thinking "This guy know the routine". I walk to the front row of benches & take a seat as I always do. The bailiff says "If you have a pager, cell phone or any other electronic device turn it off now.
It seemed like forever till the judge came into the room. There was about 5 redneck guys "21-25" sitting a row or two behind me talking about all the charges they have had in the past. From speeding, DWI's, to distribution. They were speaking pretty loud so I couldn't help not to hear everything they were saying. Oh well...It helped to pass the time.
The judge came in & tells everyone how the system works & what you can plead. The whole time I was keeping eye contact with him. I could tell he noticed this. He said that he was going to be calling the cases that the court figured the people would plead guilty. I don't know how they assume this.
So he begins calling people & things seem to be going pretty well. Then he gets to some 17y/o kid & I guess that got a little under his skin. After that he was like a different judge giving 1 or 2 points to people going 20 MPH over the limit.
This has to be the case of the day. The judge calls some guy up for going 85 in a 65. The guy says guilty with a explanation. Says he has some sleeping disorder & that he fell to sleep while driving. Judge didn't take that into consideration & sorta threw the book at him. It looked like the guy was about to cry. I was hoping the judge was going to take his license right there on the spot. Made me think a little about other drivers on the way home.
Well the judge calls my name.
Judge:You are here today because you were charged with negligence.
Me: Yes your honor.
Judge: How do you plead?
Me: Guilty your honor.
Judge: What were you doing to get charged with negligence?
Me: I was going over the speed limit.
Judge to officer: What was the reason for negligence?
Officer: Exceeding the speed limit.
Judge to officer: How fast was he going?
Officer: Over 100mph.
Judge to me: :eek Do you have some sort of death wish?!?!
Me: No your honor. Of course not.
Judge: Well you could kill someone going that fast. This officer gave you a pretty big break. A ticket for going over 100mph is 5 points. Do you have anything else to say for your self?
Me: Well your honor, I tried to go to a driving improvement class, but I didn't have the paperwork needed so they wouldn't let me in, & I have been going to some local auto-cross events. I take it to the track now. =)I owe the second one to you guys.(=
Judge: Well the front license plate charge carries no points. $330 for fines & court costs. No points.
Me: Thank you your honor.
I swear when the officer said I was going over 100mph I heard 1/2 of the court room gasp, and then when the judge gave me a fine with no points a ugg in disbelief.
I couldnt imagine being a judge. They have to hear some of the craziest stories ever. You deal with more BS than a fcuking farmer.
So I'm happy with $330 in fines & NO points. :alright

:eek Congratulations! I never thought a judge would consider taking autox/taking it to the track as an excuse.

I am going to court this friday for 79/55 I hope I can get off as easy...my record is clean as of now.
then I go back again on oct 7 for reckless, 96/55, speed greater than reasonable, no front plate...if I get points on friday, it will surely screw me on the 7th.
once again you are a lucky bastard and I hate you... doing over 100 and a negligent driving ticket :stickoutt
maybe i'll have to use the KeEp It OFf dA sTReETz plea myself...
