Alright guys, as some of you may know...I just picked up an M3 a few days ago

...So the story begins,

Last night I was at my girlfriends house 45 minutes away. We went to get a movie, and leaving the parking lot I hit a stop light, and a jetta pulls up behind me...The guy driving gets out, runs up to my window and full forces punches me in the temple...I say "What the fuck?" and before I can finsih the sentence, another bash to the side of my head... He shouts off "You ran my girl off the road three weeks ago", then runs off to his car and flees. I grap his plates and call the cop

....now at the hospital, I get examined and have a concusion and potentially a broken jaw. The cops show up and say they got his information from the plate number, and ask me what I want to do... Still a little shaken up, I call my dad and he says tell them to bring the guy in.

...Now at the police station, they call the guy and he voluntarily brings himself in. Comes in, and the cop asks "Do you want to be in the room when he comes in and we question him?" I say "absolutely" ... They bring the guy in, the officer asks him to explain himself and he says "This guy ran my girl off the road 3 weeks ago and I know it was him because he was driving a Black BMW with blue temp tags, so I saw him, got angry and punched him" ...I jump in quite pissed and say "Hold the fuck on, I have in my wallet the temporary registration that says I have had temp tags on this car since TUESDAY, two days before yesterday...So there is no way this is even me, this is the first time I have driven the car to Virginia and the temp tags aren't even blue" The cop and the guy who hit me in the face both get dropped jaws...And the guy who hit me says "Oh then it must not have been you" to where the cop literally chuckled and says "Even still, it's our job to punch him in the face, not yours"

...So basically, HE SLUGGED ME IN THE FACE TWICE, and I DID NOTHING -- and now he flat out says it wasnt me.

As I left the police station the officer ran out and handed me the phone number of the guy who hit me in the and said "He told me to give you this incase you want to deal with it out of court"

...So I have a court date, but what do I do...talk to the guy out of court (I dont want him having my information to be honest, because he is pushing nearly twice my weight and I want nothing to do with him again) or go to court...and what will happen to him? I'm not looking for money, but I wan't the guy to get what he deserves

Make him kiss your ass, litterally, and if he sees anything, for him to clean it up while he's down there.

But maybe you should let a lawyer take care of this one?

thats what im going to do...I just figured I would vent and maybe at the same time catch someone who knows anything about what assault and battery charges will bring him...Because thats what they are charging him with

If you arent looking for money and you want him to get what he deserves, then make him goto court and face some jailtime. He'll think twice next time he decides to think he is some bigshot...

Yeah, that guy ain't "stable", don't give him your info, and send this creep a message and teach him a lesson, one he obviously needs to learn.

Take him to court, press charges, and see it thru. He'll likely get Simple Assualt, pay a fine, do community service, and end up on probation for a while (which he needs, cuz it involves mandatory drug testing, they monitor his travels, verify his address, etc), depending the ADA you get prosecuting the case, etc...

If you wanted to, you could also sue him in civil court for the assault, your hospital bills, any follow up medical bills, pain & suffering, etc, if the concussion causes any complications for you with work, activities, sleep, etc...

Two words: Neck brace. Actual damages and Punitive damages has a nice ring to it.

:eek: That is crazy! You should most definitely go to court. There is no reason to let this guy off easy. Chances are he has a history of these sorts of actions which could very likely send him to jail were he belongs.

You don't need a lawyer for criminal cases; the DA will take care of it (at least that's how it works in MD.) I see no reason not to file a civil suit against this guy also for medical and any lost wages if for nothing else. It is one thing to not sue somebody for an unintentional act against you, but for this I would stick it to him.

Follow up with the cop on who you can contact at the DA's office, get that ball rolling, and then call a lawyer for the civil case...

The DA should contact you prior to the court date to discuss the facts. If that doesn't happen you can call the State's Attorney's Office for that county and ask to speak with the person handling your case.

Also, don't forget to take plenty of pictures of any injuries (bruises, etc.)

At this point, sue his ass. Was your girlfriend in the car and did she witness this? Bring hospital records, police files, whatever. Don't bother with confronting him outside of court-let the court handle it.

Yeah dude. Try to f him up legally. That'll hurt him more in the end (quite literally if he is thrown in jail! HAHAHAHAHAHAHAH). Outside of the court-you'll only escalate it and it will just get ugly.

I made haste for my cars sake and got there before he did. I will admit i was afraid he was going to do something but if he had I was going to look foward to sending him to the hospital.

I'd prosecute to the fullest. We've given up the right to settle differences do the death in the name of civilization. This guy started physical confrontation with an innocent party with his family in the car.

This is way worse than Glenn's situation, and Glenn had every right to handle it the way he did. your responsibility, since you did the classy thing and let the police handle it, is to now prosecute to the full extent.

The guy is extremely lucky he isn't seriously injured now with no recourse.

Get a really good lawyer. Who knows you might get a nice settlement take the dollars as they come. You can also throw him in jail then still sue for money.

It might be tempting to let it go, especially as time goes on and you start to forget about the event, but DON'T let yourself think this way, keep reading your story on here to refresh your memory - that SUCKS and there's no way you should let anyone that messed up go unpunished.

don't pay w/in that 12 years...guess what?? they can file for
another 12 years. BULLSHIT!!!!!

so...i pretty much just forgot about ever getting my money...
oh well, learn something new everyday, right?!

Are you sure they have 12 years? Sounds a little odd. Even if they try to wait the 12 years, I'm pretty sure you can collect interest on the money owed. It is probably something like 10% but I think it gets set by the court.

First you take him to court, sue him, get money and land his azz on probation. Then you go out and find his girlfriend and cut her off. Of course he can't do anything 'cause then he'll be in jail for sure. :D :mad:

After speaking with family lawyer -- he actually could be facing two years in jail ... potentially what could happen is on the day of court, we show -- and his lawyer can say "We would like to speak outside of the courtroom to try and settle this without a judge" -- AKA he doesn't want to go to jail, how much will it take to buy me off and not go further with the charges. I initially wasn't concerned with money, to be honest I just wanted him to get what he deserves -- and also I don't want to be one of those people just "taking him for all he's worth" ...

but this is the situation that makes me pissed and not feel so bad for getting what many people say "I deserve" although Im still unsure --> This isn't a fender bender where I am turning around and saying ouch my neck hurts, gimme money. This guy was driving the opposite way on the road as me, saw me -- and then turned around with the obvious intent of beating the living S out of me. He knew what he was doing, and it is truly insane to think about someone being that unstable.

So I am currently in debate as to what I should do, simply go for getting the guy probabtion/jail time ... or getting something out of it for myself for the ~$200 in doctor visits, plus wasted time, the fact that I still can't open my jaw all the way (And to be honest, from the people -- including the lawyer -- that I have talked to, I could potentially pull down some big numbers for this incident)

The judge might decide to just give him probation and have him take some anger class / community service. Talk to your lawyer and see if you can grab the cash AND force him to take some anger management course. :dunno

I hear ya on the "not being someone to take him for all he's worth," but you need to do what will compensate for loss of time, medical bills etc. But he's a freakin' maniac that needs help. I agree with Eric and see if you can get some kind of restraining order on top of it. (obviously I am not a lawyer, though).

jeff-after any incident is over is VERY easy to forgive and forget, especially when a few months go by. Don't do that. What if it was your mother driving your car to the market when he turned around and punched her because he thought she ran his girl off the road. I would go after him, people like that don't deserve to walk the streets.

Thanks for the advice guys -- I'm not going to forget it, because exactly like you said George, what if it was my mom or girlfriend driving. Obviously he is crazy hauling off and knocking me out for doing nothing ... so the more and more I think about the pain in the ass it has been to try and brush my teeth with my mouth half open and sleep on one side so my head doesnt hurt -- i'm getting more and more pissed.
