View Full Version : Who got a Speeding Ticket going to Bimmerfest

On the way to Bimmerfest today, I got pulled over by HW Patrol. She told me I was clocked by airplane at 91. But, I found the post below saying that it is illegal in CA. Does anyone know if that is true?

The use of aircraft in enforcing speed laws was meant to supplement and aid the officer on the ground in catching speeders. The pilot was meant to act as a spotter for the patrol officer, to help him see the speeders that had not yet reached him. The officer on the ground is still supposed to independently verify the suspect's speed. However, this original intent has been undermined in practice.

The police pilots gauge your speed by timing you across markers on the road that are visible from the aircraft. Your speed is then determined by calculating how long it took you to cross the know distance between the markers. This method constitutes an illegal speed trap under 40802(a)(1), because it is illegal to calculate a vehicle's speed using a time-distance calculation.

Didnt you say something like you were actually doing 100 and if he clocked you in above 100 or at 100 you will have had your lisence suspended? maybe it was someone else i dono either way that sucks dude hope works out get a lawyer win the case

Me too but I wasn't even driving my bimmer. Just cruising downhill with the rest of the cars at 80mph in a Tahoe. CHP was waiting at the bottom of the hill.

me and rob were doing 100ish on the way home, i thought we were flying until a 330i flew by us. no tickets here though. BTW, from the last few years, i can tell you fighting those plane tickets basicly asures a win, especially the mail in method.

He continued his personal embarassment by showing his inability to drive the car smoothly, it was amazing that the REGULAR e46 driver was able to make much smoother/safer transitions than that idiot.

Anyways, I hope he reads this, he's a real jackass.

there were a number of jackass drivers on the road today. it's a shame. on the 101N at around 8:15, a EVO was pulled over and my V1 picked it up. immediately after we passed the EVO (going 65), the cop radios ahead (caught this on the scanner) and says that there are 4+ modified BMWs speeding on the 101N. from that point on there were 2 or 3 cops spaced out on the 101 and i kept cruise control on at aout 65. i think some of the folks that we ran into didn't understand why the DINAN7 was holding them up, but just so you folks know, for those without radar detectors, you guys should consider yourselves lucky.

I got pulled over on the way there but was not speeding when the CHP officer pulled me over. He didnt clock me nor pace me and just pulled me over because I was driving at the front of a group of m3s. Spent 30min explaining to him that I was not speeding and that he has no proof I was because he didnt even know how fast I was going. He even admitted that he pulled me over because it was most convinient. In the end he let me off with just a front tinted window fix it ticket. Damn I need to get this signed off some how without removing my tint. Oh wells still better than a $200+ speeding ticket.

I was leading the last portion of the OC caravan up to Balboa park, Even when the left lane slowed down to 55 at some parts, I stayed in the lane so as not to break up the caravan. From balboa park up to bimmerfest there were some stupid drivers that don't know the concept of a "caravan"



Anyways, does anyone know what happened to the black E30 325is that crashed? He was a part of the OC caravan and he crashed right on the 405/101 interchange.

we got a ticket too.. according to the lady "chippi" (what she called her fellow officers), the plane paced us at 99mph. i too think the plane thing is illegal, and i'll def try fighting it w/ your info. thanks..

ill admit, we were goin "fast", but if i have a chance to win this one... well damn~ im gonn fight it. lol

all in all.. it was really hot. i go the farmers tan AND the sandle tan goin on. there were way more girls that the last two bimmerfest that ive been to. id go again next year, but i want a better spot.

the accident was right behind me, in fact the car right behind me was the last car to get hit, thank god! well basically as we were merging onto the freeway(101) this civilian was trying to get in behind me, and some jerk that was caravanning to bimmerfest would not let this poor guy in. I sped up hoping to give this guy some room and he finally snuck in. Well right after we merged, i saw Serg (99 Cosmos M3) hit the brakes, and I hit them as well as we were going pretty quickly. I could feel my ABS kicking in, and I instinctively looked behind me and saw that guy had plenty of room. We then stopped, heard a crunch and a e 28 5 series, and an e 30 hit each other, and also hit the guy trying to merge in behind me. Pretty much it seemed like an accident was inevitable, the way things were going right before the freeway switch.

damn, some aggressive driving. We were driving pretty safe, occasionally we'd have 100+ bursts, other than that, no weaving in and out or anything, i almost got caught doing 120 by the chp, gotta admit, pretty stupid on my part.

No tickets or what not, but I felt REALLY bad about 2 of my decisions yesterday during that time. Luckily, I came out alive, and hopefully no one was hurt. To those around me, sorry, dont know what I was thinking.

I think most people were pretty sane considering the number of people at the meet...

everyone standing in the middle of the on-ramp/off-ramp at the first road rally stop weren't too smart either, holding up non-bimmerfest cars and the CHP...

I'll admit I was driving fast out there this weekend but wasn't weaving in and out of traffic or driving jerky...

hopefully we can have a fest next year with no accidents and fewer crazy drivers...

overall the fest was a success though

if you got a plane ticket, try to fight it. most of the time the chp is using the estimated speed given by the plane, and that is illegal speed trap. the plane can only assit the officer on the ground which has to clock the speed.

i too got a ticket by the plane two years ago. so last year i drove a lot more careful (was not able to make it out this year). i was planning to fight the ticket by mail, but i lagged and missed the date. i know tc535i lost, however, i heard some other guy that was at the bimmerfest fought the ticket and won. doesn't hurt to try.

Wow, a GT3. I wish I could have been in that group.

In my group, we made good time, with some bursts over a 100mph, but nothing too crazy. Actually one big group, turned into a smaller one after getting stuck behind traffic, but each time that happened, we saw the CHP on the side of the road with a few cars. I guess in this case, the traffic saved us.

well i was really lucky the way down there not one ticket, then during after bimmerfest no tickets, then decided to go down to ontario street races and recieved an exibition of speed ticket :( but somehow i talked him out of impounding my car and now my friend has a ticket cuzz of me. on the way back i had been quite lucky too alot of close calls but thanx to the v1 no speedings

I won't give his name out of respect.

After the Fest a bunch of us hit State street for some dancing and a little partying. At the end of State Street they set up a sobriety check point. I was first through and while the cop was talking with me one of the guys with us came speeding under the under pass with his loud exhaust and chirped the tires when he stopped. The cop looked his way any gave a sinister grin. He checked me out and let me go ( I had 3 beers all night). He also let the other guy go with a warning. Wow did he get lucky. He says he'll follow us back to 101 and when we get back on the freeway he punches it. I was doing 70 and he flew past me. We tried to call him on our radio but his must not have been on. We turned off at Turnpike and he kept heading north on 101. The next morning we find out he didn't get so lucky the second time he got pulled over. This time he got a DUI and speed well over 100mph. He was lucky they didn't impound his car and they gave his girlfriend a ride back to her hotel. To make things worse, his hotel was on State Street so he missed his turn off by miles when he got tagged. When we left at 10:30 the next day he was still in jail and wouldn't get released until about 1:00. He's a very good guy who let alcohol take over his common sense. We did offer to drive for him but he seemed OK until he got behind the wheel.

Oh regarding to the date on you ticket. I wouldn't worry about that. I believe it is by that day you have to pay the ticket and decide if you want to challenge it or not. If you decide to fight the ticket, you will be giving another court day to appear infront of the judge to declear no guilty. Then after that they will give you another day to come in and defend your ticket.

I think that is how it goes... if someone else knows more please let us know.

First off i would like to say that Bimmerfest was great, i really enjoyed the location and there were a lot of awesome people and cars. Next, i would like to say that i am sorry for anyone who got tickets and i hope that airplane shots can be over ruled in court.

now to a more personal side. i didnt get a ticket, at points, sure it was lucky, but many times were other cars blasting by me at 130+. I didnt have any close calls and was in control the entire time. I think it is ridiculous that in the BMW community we are calling each other a$$wipes and idiots. if it is so bothersome, then mention it in a civilized way.

As for on the way back. I cruised at 75-80 the whole way. no harm no fowl. Mrclam, who was in a black e36 sedan was along side me the whole time, and do remember, he did go through an intersection at 60 and totaled his M3. Plus he does have a little bit of a grudge because his product short circuited and lit my friends e 46 on fire.

I dont like people bagging on me or anyone else. we are a community. everyone had at least 1 closey saturday. i mean come on, that gt3 group was chillen at 160. i didnt get anywhere NEAR that. At the end of the day everyone was safe and had a good time. Oh by the way, if anyone has tight video tell me, we are making a Bimmerfest 2004 video.

i drove pretty normal the whole time. a couple times i tried racing a few ppl and blew by about 3 bimmers one time going about 160. it was fun lol :)
i think that some of these ppl dont understand the driving habbits of others, its not like we think right b4 we swerve through traffic thinking oh this is stupid we do it and then relize what we did. its a small adrenaline rush and this kind of driving is what makes some of us better race car drivers than others. if u dont think about death or an accident then u drive better on a track than others. for example group b rally car drivers. only problem is the road is not a real track even though alot of us act as if it is.

Sorry, didn't go through an intersection at 60, my car was totalled as a result of the actions of another driver who was inconsiderate, don't relay information that isn't fact. You weren't there.

To be honest, I didn't even think it was you. At first I thought it might've been, but the driver looked much younger than I remembered you, too bad.

It's not just about the speed you are cruising at, it's about how you handle the car at that speed. If you had been watching your car from a distance like I was, it's pretty clear that you couldn't drive your car smoothly.

Leaving your rhetoric aside and idealism about us being a community aside, take the criticism and walk away, I'm not the only one who witnessed your driving, as witnessed in this thread. Don't blame your actions on what you think happened in a different situation, take responsibility for what happened.

As for references to your friend, it's a good idea to leave those comments outside of a public forum while things get settled.

To me, I don't really care who's car it was, who was driving, etc, I don't hold grudges. This is not about the situation we have with your friend and I, nor about my own accident. This is about the driver of your car on the way back from bimmerfest, and that only.

I didn't see you earlier in the day, so I have nothing to say about what the others saw, but whoever drove your car home was driving very poorly, and hardly anything near what I would call safe.

**** the CHP. They got nothing better to do? As far as I can recall, we weren't racing up the 101. We may have been traveling at higher speeds, but not unsafe in anyway. This typical BS to raise revenues for SB and the state. We all know that drivers that drive faster and do so in high performance automobiles are better drivers than slowput drivers do. The goverment would love for you to believe that driving slower = safer. Germany has much lower accident/fatality rates than the US does b/c they drive damn better cars and do so at higher speeds. Maybe if american's learn to adopt a culture of performance oriented driving, we'd have less problems. Speed doesn't kill. Slow, overly-cautious, timid, older, unattentive, and snoozing drivers kill.

Flame me if you will, but I do not regret speeding to bimmerfest or any other day I drive. I've been in many situations where unexperienced drivers swerved into my lane, cut me off, and just do plain retarded things b/c they weren't paying attention, but I was paying attention to move out of their way.

She laughed and said, no, we don't have quotas. I said, sure, whatever, you mean it will just will make it look like you didn't just sit on your ass all month. She laughed again, but didn't respond. **** CHP. She also told me not to bother fighting the ticket. BS. **** her, I'm fighting it all the way.

Another thing, the female pigs said the mroadster was doing 91 and the e36 M3s were doing 92. WTF? just guessing? btw, they did not hit us with radar b/c I had already slowed down and we all had bunched up behind the silver corolla. if anything, they would have hit the corolla, which was going 65. So I believe this ticket is full of shit.

Keep us posted on any info about the airplane stuff.

I totally agree. Because I asked her directly to see her radar and she said she doesn't have it and 91 was a reading coming from the airplane. For sure she didnt' clock us at all. She also told me she will appear at the court house if I fight the ticket. But, I wonder how often they will be able to both appear at the same time.

I was pulled over by one CHP car and one CHP bike. I was goin 120 but they didnt get me on radar. also some random bit*h told CHP i threw something at her car...i would never! :rolleyes: I didnt get a ticket though...as usual and i asked CHP on the bike if he would go to bimmerfest taking in the fact he had a bimmer and all....HA HA! lol No.....though...the conversation ended very positive and frankly i felt the cops were 20X better than the last event (socal/norcal) I even thank a couple po's at the local starbux too. :D

Um, 1) the use of the curse word was for emphasis on how badly they need to grow up, and 2) had I been on that road and one of those idiots hit me it would have been a personal attack with even more dire consequences. I tried calling in to extend my ticket which is due on May 28th. They said my ticket wasnt in the system yet. Who knows, maybe we are all off the hook. Definately try to contest your ticket though. I just won a ticket I got back in Dec through trial by written declaration. They should be sending me a full refund in a couple of weeks.

Hey guys, I didn't receive my ticket in the mail either, but I checked this website out just yesterday. Type in your drivers license number in the given area and it'll pull up your ticket file.

Through that site, I found out that my ticket was worth $341.00, without the superior court charges and whatnot. It also says that my appearance date was moved to JUNE 11th, 2004. Good thing I checked, cuz i was headed to Ventura just for this damn thing on Friday.

Yeah we were the lucky ones that day. I was wonder how she is going to proof that we were going at that speed when she doesn't even have radar to show me.

California Highway Patrol officers are trained to estimate a car's speed by eye, and they're very very good at it and it holds up in court based on their training and experience. I've experienced it first hand and the officer was dead on accurate and never even paced me or used radar - just his 15-year experienced eyeballs, and i later lost in court. Airplane tickets hold up in court too - they use them in the Santa Maria area on the 101 and i sat through several airplane cases where everyone was found guilty before my case went before the judge. There is a cushion of doubt on the estimation which is why they only target cars going at least 10 mph over the posted limit. Unless you can prove that the CHP's airplane method is inaccurate or flawed (which it is not) it'll be pretty hard to beat in court. The court will always give the nod to the officer over the defendant. I''ve been driving for 30 years and had plenty of court battles but i've never won against the highly trained CHP officers. City cops on the other hand are easy to dispute, but the CHP does this stuff every day and they're very good at it.

If you guys are going 85-99 mph the officer knows full well you're speeding even if his estimation is off by 5-10 mph, you're still well over the limit and he knows it, and his proffesional estimation is plenty good enough for the judge. Hell i can tell the difference between a car going 65 and one going 75, and i'm not even trained.

I hate CHP.

And not carrying insurance is your fault and nobody elses; you need insurance you dont carry proof they dont know, nobody to blame but yourself.

Yea I talked the CHP out of giving me a speeding ticket some how. Another one of my friends got pulled over on the way there also and got off with a warning. Guess we were just lucky. But either way.. $112 for a tint it ticket, thats outrageous.

You might want to consider hiring a good traffic ticket lawyer. In the cases i sat through in traffic court none of the defendents had attorneys, like me they just defended themselves. I also sat through a bunch of cases in a Malibu court while waiting for my time before the judge (i got cited for blinding a CHP car with my driving lights in the canyons) and just about everybody was found guilty - and none of these folks had lawyers either. From all the posts i've read on the net over the years your best chance of getting out of a big ticket or get the fine reduced is to hire a traffic laywer. A good newsgroup to read is alt.law-enforcement.traffic; there are lots of cops there that give great advice and there are testimonials from speeders themselves. There's lots of discussion about traffic enforcement and traffic court.

From everything i've read it's better to invest in a traffic lawyer - you have a much better chance at winning or getting the charge reduced which will save you a ton of money on your insurance for the next three years the ticket would normally stay on your driving record. My boss's 18 yr old step son recently got an 87mph ticket on the freeway - his fine was over $400 (he simply paid it) and was soon shocked to find his insurance rates TRIPLED and unless he can find a cheaper company it'll stay tripled for the next three years! So far all the quotes he's gotten are almost as much as his current company has raised it to. Others won't insure him at all with just that one ticket. Getting caught speeding nowadays no joke like the old days. I don't like lawyers but i think they're the lesser of two evils in this case.

The CHP isn't stupid, they have the laws of the state of California behind them and i think if airplane tickets were so illegal or considered to be "speed traps" they wouldn't continue to use them for so many years all across the state. You should get more feedback about the legality of such tickets and the viability of beating it in court from people who actually know what they're talking about. Not just some kid that says "it's a speedtrap and won't hold up in court". Get proof of this. Air enforcement is actually increasing and they're using it in more metropolitan areas now and not just out in the booneys like in years past. I saw a news report about it last year and they showed how they pick the cars from the air - the ones going 20 mph faster than everyone else stuck out like a sore thumb and were easily clocked from the air. And remember the majority of other cars in traffic are already going 10-15 over the limit and the CHP doesn't bother with them, they're going after the big ticket that is harder to fight. If a CHP officer says he estimated one's speed at 99 that's still 34-44 mph over the limit and even if he's off by 5-10 mph that's still way over the limit. The Judge also knows that the officer probably wrote 99 mph to give the driver a break and avoid having to take him to jail and spend an hour to do the paperwork and that the driver was probably going well over a hundred. A 99 mph ticket is more convenient for the officer. And Judges are impressed when you show up in court with an attorney and are much more likely to give him a break compared to a unrepresented scofflaw there by himself. Lawyers know how to work the system, it's what they do.

I've gotten a lot of tickets in the past, fought some and won, fought some and lost, and the rest i paid and went to traffic school to keep them off my record and off my insurance but these were all relatively minor at 5-20 mph over the limit. I learned a LOT in traffic school about how to NOT get caught speeding. I also set out to learn as much as i can about speed enforcement and how these guys do it and now armed with all this info i haven't gotten a ticket in 8 years now although i drive very fast, especially on the freeways. A lof of awareness, a scanner, and a V1 go a long way toward staying invisible :D

Yeah I will be toast if they do show up, but I guess traffic school is an option then.

I would rather take my chances and fight it than to just pony up the money and let them win by not taking any action to contest it. If I loose, it won't be b/c I didn't try.

If the speed is too much above the limit they won't even let you take traffic school for it. If the ticket does have the option of going to traffic school, you have to choose it ahead of time instead of pleading Not Guilty.

Once you ask for a trial date, the option of traffic school is taken away. If you plead not guilty then later go to court and the cop shows up there will be a trial, and if you lose your case it's already too late to ask for traffic school and the ticket goes on your record.

Yeah, everybody who I've spoken to has tried to fight their cases with the CHP and all times they never showed up.

That's good, maybe now with all this homeland security duty and the shortage of CHP officers statewide they're stretched too thin and can't always make to court. Some years ago they always went to court, sounds like that's not the case anymore.

The CHP officer that taught one of the traffic schools i attended said they try to schedule their court appearances on their day off so they can get double-time. I'm only going by what he told us. Maybe they only get time and a half if they're on duty? Dunno. Doesn't really matter anyway........

Who are the first people on the scene of a highway accident before all other units? CHP. Who is there to make sure that you have chains on your tires before letting you head up a snowy mountain? CHP. Who has more First Aid gear in their trunk than firearms? CHP. Who is out there busting the dumbass that have had a few drinks and still think that they have full control of thier cars? CHP. Who is out there investigating fatal accidents to see if maybe there wasn't something else wrong with the road that could be fixed (like guard rails on canyon roads) to possibly save someone else's life in the future? CHP.

The officers in the cruisers ARE out there to try and make the roads safer. Every once in a while they hand out tickets to people that are obviously a hazard to other motorists (and I've gotten a few myself). I agree that the bike officers for the most part are just for collecting extra taxes, but the ones in the cruisers are out there looking out for us. Their sole job isn't to hand out tickets, and if that's all that you're seeing then YOU are the naive one.

You got a ticket, suck it up like the rest of us do. I'm not saying don't fight it if you think it was unjust. I'm just saying don't whine about CHP officers not being out there to protect us. Even if we need protection from ourselves.

Really? That's not what I heard. True, the option for traffic school you originally had is taken away, BUT I heard it's now at the discretion of the judge. The judge may or may not offer you traffic school, depending on your record and the situation. If this is your first offense, he'll most likely offer you traffic school, EVEN if you plead not guilty and lose.

At least that's what I heard. :dunno

You're right - i've heard about judges doing this after finding someone guilty but i forgot about it. Several years ago the judges didn't have this discretion because traffic school absolved you from paying the fine, but when then Gov Davis found out the State was losing out on all this fine money he changed the law to where you now have to pay the traffic fine even if you do traffic school. That's when judges started to give people a break and allow traffic school after the fact in some cases. But i don't know if a judge can offer this if the citation was too far over the limit to allow traffic school in the first place. More questions to ask a good traffic lawyer :D

Judges can also over-ride the rule where you can't take traffic school if you've attended one in the past 18 months.

Not true. I had a 88mph in a 65mph. I contested it, delayed like 2 times, had my court date about 7 months after the ticket was issued and the cop showed up. He presented his case, then I presented mine. Did my defense, lost of course. Then when the judge read my my fine, I asked if I could be granted Traffic School, and the judge said "yea sure". My experience is, be courteous, and nice during the trial. If you ahve something to say...say it but dont' try to attack the cop in open court, you'll never win points like that. The judge even told me I had a really good defense, but it wasn't good enough. I'm only 20 and I look like I'm 17. Dress sharp, be nice, and it can go a long way. Oh yeah, I got traffic school about 3 weeks earlier for going 90 in a 45 zone, again by being nice and courteous.

Judges and cops deal with a lot of assholes on the road day in and day out. If you show them that you are there to excerise your constitutional right, with no extra fuss they usually applaud it. Just don't expect to win if the cop shows.

im confused as to why the people who were speeding shouldnt have gotten tickets. did you really expect them to sit and watch you endanger other peoples lives. you should have been smarter this was a big event lots of modified cars of course they are going to be around. for being a stupid ass and speeding at that time you deserve a ticket sorry.

My only gripe was that they "paced" us from the air, and they didn't even give the three of us the same ticket speed. If they paced us, it should have been an estimate, and SGI being the leader, should have gotten a higher speed reading than us, IF not the same as JT and I. Turns out he was 1 MPH SLOWER than us. Is that possible, to get a difference like that from pacing our speed?

That's the main thing that pisses me off.

Yes, because my age has a lot to do with your unsafe driving.
The CHP gives out tickets, yes. Does the chp give out tickets to people obeying the law? no. Does the chp give out tickets to people going 10 miles an hour over the speed limit? not unless its unsafe to do so.
There is no situation in which going 90+ on the freeway is safe. I say that having gone well over 110 on the freeway. I know its not safe, i take full responsibility for it, and were i to get a ticket i would not be bitching about it. why? because i know I am at fault.
You are at fault for both your speeding ticket and your failure to carry proof of insurance. Nobody else is responsible. blaming the chp officer for getting a well deserved ticket is like blaming bmw for your speeding ticket. It isnt their fault; its yours.
