I've been getting the stupid "brake light circuit" message but I didn't thing it would kill the brake lights. I checked the fuse and its fine.

I did a search on the break circuit and I could not find anything related to the brake lights failing because of the switch. Could that be the cause of the problem?

Well, seeing that the switch is what turns the brake lights on and off, I would imagine that it could be the cause of the problem...

I'd suggest just replacing the switch - it's not a difficult job (just a little awkward), and not very expensive.
