View Full Version : I just got into my 1st accident...
GimmieSumMo72 08-18-2008, 09:54 PM in 11 years and its my 1st accident in NJ!
I was hungry and was in the mood for some fried chicken... I know... I know... GHETTO!!!
Well, they closed the KFC on Rt. 1 North by me next to Grease Monkey. So I decided to go to Popeye's in New Brunswick. Right in front of DeVry there was some traffic building up and I was trying to get from the left lane into the right lane. So, when I was stuck in the left lane behind this car, I decided to get into the middle lane and then I turned on my right signal on again while I was passing the tractor trailer in the right lane.
So, I passed the tractor trailer and started to merge into the right lane, then traffic was coming to a stop again, mind you we're going less than 10mph! The trucker and I make eye contact and he waves me on. So I start crossing in front of him but he never stops!
That's when his lugs meet my rear passenger quarterpanel and rim. After i finish getting into the right lane in front of him, I get out of my car, to inspect the damage.
As soon as he jumps out of his cab, I tell him that he hit me and he never realized that his truck came into contact with my car, and start shouting at me that I hit him!
There was no damage to his truck, so he kept coming in and out of his cab and yelling excuses at me. The last one he yelled at me was "That happend prior!!!". My response was "I have pictures from yesterday". Those were the last words we said to each other before the cop came.

Since this is my 1st accident in NJ... What the hell do I do?
I don't want to contact my insurance since it wasn't my fault. But I don't have this guy's info since he wasn't cooperating and the cop had taken down all the info.
motorwerks 08-18-2008, 10:07 PM I don't know if things are different in NJ, but in PA your insurance company can take care of it for you. I would call, and explain what happened, and give the claims rep the police report number. From that they should be able to get the report, and the other drivers info.
When I was involved in a similar situation that's what I did, and it all worked out. I had to pay my deductible, but once they recieved payment from his insurance company, my insurance company refunded the deductible payment.

Actually in NJ you can't get collision or comprehensive separately. With the car being worth less than 5k on the books, I didn't think it was necessary, and in their eyes, mods don't add any value to the vehicle.
It's pretty stupid but, whoda thunk it... less than 10 mph! I think that I'd be less urked if I had totaled it!
xtremsiege2 08-18-2008, 10:15 PM ^^Yup. If the accident is in your favor you won't have to pay crap. I recently had one and am currently going through a similiar situation where a lady hit me. Just remember if you haven't already, report the accident to your insurance company ASAP and make sure the other drivers insurance company is aware of the accident. That should speed up the process alot. It sucks the truck driver and you didn't exactly get along, most people don't and will do almost anything to get out of the situation.

It probably depends on the state. Generally you have to contact insurance yourself. I just noticed you posted before me that you don't have collision, I'd wait and see how the police report turns out. Worst case you drive a slightly damaged 3 series.

its ok. just give a copy of the PR to the insurance guys. it shouldnt cost you a dime. his info is in it.
this is why i avoid all those places. all together.

Contact the County Vo Tech and see if they will let their students do the body repair.
You pay for the parts / Material etc............ Labor is usually discounted or free
They won't gaurantee the work of course, but it's better than driving the car that way.
Morris County Vo Tech has a body shop ( I think they all do )
So if your county Vo Tech won't do it, I am certain another one will.
Or bring it to Morris County

Cop came and made reports. But for some reason, the report said it was no one fault's. i got the trucker driver info from the police report and try to get compensation,but the truck's company insurance said the police report stated that it was no one's fault. I end up with a huge dent in the rear of my car. I hate Truck drivers in NJ. they never know their surrounding.

First, Mo needs to see the report.
If the trucker is found to be at fault, he should be ok
Unless the trucker disputes what happened
Then it's Small Claims court

when the cop came and asked what happened, i told him that i started merging with at least 50 feet between me and the car in front of me. but he took it as 50 feet in front of the truck.
the truck driver said he was on the phone when i crossed in front of him, then the cop told me that I didn't have 50 feet clearance to merge into the right lane.
so i kept my mouth shut and all i said was yes, sorry, thank you to everything the cop said afterward.
the trucker did all the talking.

this guy was a redneck from nebraska! a true scumbag redneck! he was 5'0" and 100lbs soaking wet! i wish i beat the shit out of him before i called the cops!
he actually had 2 cameras and started taking pix with a polaroid and a digital camera.

the mechanic who lets me work in his shop is a partner of a body shop in South Amboy.
he told me when I get the police report, to call the trucker's insurance co and file a claim and he'll do the rest of the talking as the body shop...

He tried to blame on me cuz he didnt see me. my car was really low to the ground too. the cop was not help full at all. i dont wanna pull the race card out, but i think the cop were more lenient toward the damn red neck.
MikeVance 08-18-2008, 11:34 PM ok with my accident the PR claimed it was his fault but no one got any tickets. as long as it says it's his fault then you'll be fine. if it doesn't, you'll probably have to take him to court. but just because no tickets were given, doesn't mean anything bad. why did the cop say you didn't have that much room?
atleast the PR will have his address on it. incase it comes down to that. we can just kill him. :shifty

yeah... for some reason, i dunno... when I should snap, i end up keeping my cool and vice versa. i've been in worse accidents than this with 18 wheelers before. maybe is the islander blood in me!
I just didn't want to say anything else after the cop said that. I didn't want to piss him off, or give him any other reasons to side with the trucker.

duce110 08-19-2008, 10:01 AM Well maybe i can help a little being that i've had about 3 accidents in the garden state... 1st, i would wait until the police report cause they won't help u without that (believe that)... 2nd, contact ur insurance company, even though u don't have collision, if it wasn't ur fault, then they would pay to get ur car fixed and go after the other insurance for the refund... u won't have to deal wit his insurance, only urs... they take care of everything... now if u notice on the police report that it was ur fault, then i wouldn't even try...
One more thing, Popeye is the shyt...

duce110 08-19-2008, 11:28 AM no it won't go up... remember its not ur fault... they do there own investigation... ur premium only goes up wit at fault (which ur not) accidents, and points on a license... if u don't wanna go through ur insurance, call his but some insurance companies try to low ball people, give u a 500 check when the cost would be a 1000 to fix... thats y i say go through urs, there not goin to hassel u cause one, ur a paying customer and 2 there really ot losing anything... whatever they pay out, they get from the other insurance anyway... the only thing is, i think u have to pay a deducible but u get that back after they settle wit the other insurance...

GimmieSumMo72 08-19-2008, 06:15 PM i asked my boss if i can leave early to pick up the report if we didn't have anything to do in the afternoon, and he said yes.
so, i wasn't doing dick today, and at 2 i ask him if there was anything else for me to do so i can pick up the report and he says yeah... he had me running circles researching stuff until 3:10. then i ask him if i can leave... mind you that the place for police reports closes at 3:45.
so i book down the TP doing about 85-90 the whole way and i get to the police station at 3:40, from harborside in Jersey City. and they tell me that records (the place that keeps the reports) is closed, they closed 4 minutes early today and I would have to come back tomorrow.
then i called my boss telling him that they closed early and all he said was "what does that mean" i told him that i would have to go back to pick it up. and he says don't you have to go to court for that parking ticket tomorrow? (i have to fight a parking ticket in JC, they booted my car for parking w/o a valid permit, while it was displayed on my dash instead of hanging off the rear view. ) impling that i have to do this on a vacation day or day off. what an ass!
but in the end i didn't get the report... so we're still waiting in suspense.
i did drop the car off at my mechanic for an estimate on the body work, so he should get back to me soon!

basically the cop wrote up both sides. for mo's it was like "the driver SAID blah blah blah, then SAID this happened, then SAID that happened then SAID thats what might have happened."
for the truckers it was "the nice upstanding citizen reported how the spoiled brat in the bmw recklessly cut him off but hit the side of his poor defenseless 18 wheeler like a mad ape behind the wheel"
although mo, send it to your insurance company. you might still not get effed.

the officer won't be back into work until Monday!:mad

i usually keep the 7 in the driveway under a car cover.

Just got a letter from the adjuster from the trucker's insurance co...
it said that since i was trying to switch lanes to exit they aren't going to pay for any repairs or restitution for the vehicle.
who the hell exits from the middle lane 200 ft away from the exit?
i guess i'll have to rip something off of google earth or something!
